Reduce Patent Prosecution Costs with File Wrapper Analysis

March 21, 2018 @ 2:00 pm - 2:30 pm EDT

As the USPTO has stepped up efforts to make data publicly available, new tools have emerged providing more data about patent prosecution than ever before. But it is not always clear how to apply this macro-level information within an existing practice—a particular challenge as one seeks to keep big picture goals on track, and avoiding discarding what is already working.

While some data may not be directly applicable, image file wrappers are an exception, providing concrete examples and insights that have the potential to be applied in day-to-day prosecution. This can be particularly helpful for the difficult and often expensive cases that, while representing a relatively small portion of the overall number of applications, account for a majority of the rejections that have to be dealt with. By turning to the substance of the file wrappers themselves it is possible to arrive at a detailed understanding of how others argued and how examiners responded in similar past situations that can provide specific, actionable insight for the rejection you are facing.

Join patent attorney and IP Toolworks cofounder, William Morriss in this webinar to learn how to leverage work that has already been done to reduce the cost of prosecuting difficult applications while maintaining or even increasing quality of argumentation. During this webinar, you will learn strategies for using file wrapper data to:

• Identify arguments that can be quickly applied to reduce the cost of responding to each office action.

• Strengthen arguments you identify as best for your case.

• Use past experience as both a guide and a sanity check for cases that hit an impasse.
