USPTO AI Guidance Reiterates DABUS Decision

The U.S. Patent and Trademark Office (USPTO) today released guidance for determining inventorship of artificial intelligence (AI)-assisted inventions. As the Office has previously stated, the guidance clarifies that “while AI-assisted inventions are not categorically unpatentable, the inventorship analysis should focus on human contributions, as patents function to incentivize and reward human ingenuity.” The USPTO issued a call for comments on AI inventorship in February 2023. That Federal Register Notice (FRN) asked the public to respond to 11 questions, including “how does the use of an AI system [in the invention process]…differ from the use of other technical tools”; whether AI inventions may be patentable under current patent laws on joint inventorship by, for example, simply listing the natural person involved in inventions created by AI machines; and whether statutory or regulatory changes should be made to better address AI contributions to inventions.

House Subcommittees Hold Hearing on Artificial Intelligence Challenges and Opportunities

On the morning of Tuesday, June 26th, both the House Subcommittee on Research and Technology and the House Subcommittee on Energy held a hearing titled Artificial Intelligence – With Great Power Comes Great Responsibility. The day’s discussion centered on issues surrounding the nascent technological field of artificial intelligence (AI), including both the potential negative and positive impacts that improved AI technologies could pose to the U.S. workforce and society in general… The specter of increased Chinese investment into AI tech development was also discussed during the day’s hearing. During his opening remarks, Congressman Randy Weber (R-TX), chair of the House Energy Subcommittee, spoke to the concerns over increased tech investment by China into AI programs and how that threatens U.S. dominance in the field.

The Value in AI will be in Solving Real World Business Problems

Technology industry leaders and consumers will find it valuable to integrate disparate AI technologies. As AI becomes less siloed, they will discover that when these different AI technologies are integrated they can deliver more than the sum of their parts… Traditional industries like professional services, including law firms, insurance firms, etc., who implement AI technologies will see a large increase in employee morale and retention. Instead of being bogged down with boring, routine tasks, employees will have the opportunity to focus on more engaging, fulfilling work. Wallqvist says that this will prompt more firms to adopt AI, in order to keep employees from leaving their firm for another that is utilizing AI to reduce the amount of low-value, tedious work done by their employees.

With 9,043 U.S. Patents, IBM Tops for 25th Consecutive Year

IBM inventors received a record number of U.S. patents in 2017, again blowing past their own previous record to sail past 9,000 issued patents. Over the last 25 years IBM inventors have received patents for such transformative ideas as secure credit card transactions, guiding the visually-impaired using RFID, the world’s fastest supercomputers and earthquake detectors. With more than a quarter-century of innovation under its belt, IBM has continued to work on the most contemporary, relevant problems that exist today. This year alone IBM inventors obtained patents in areas such as Artificial Intelligence, Cloud, Blockchain, Cybersecurity and Quantum Computing technologies.
