Happy 40th Anniversary, Judge Pauline Newman!

Today, Judge Pauline Newman celebrates 40 years on the U.S. Court of Appeals for the Federal Circuit (CAFC). Newman was appointed to the court on January 30, 1984, by then-President Ronald Reagan and officially assumed office on February 28, 1984. Newman was the first judge to be appointed directly to the Federal Circuit; all of the standing judges at that time attained their position through the merger of the Court of Customs and Patent Appeals and the appellate division of the United States Court of Federal Claims. She filled the Federal Circuit vacancy created at that time by Judge Philip Nichols Jr., who had taken senior status.

How the New USPTO Director Can Impact Patent Subject Matter Eligibility and Post-Patent Grant Challenge Proceedings

As the challenge proceedings and the Patent Trial and Appeal Board mark their fifth anniversary, we should reflect on whether they have achieved their intended purpose. About a year ago I explained how inter partes review proceedings are no more a true alternative for litigation than the inter partes reexamination proceeding which they replaced and supposedly improved upon – nothing has happened since to change that view. Furthermore, a buffet of other meaty issues remains with respect to the post-grant challenge proceedings… I continue to support the original goals of the challenge proceedings and while changes in some areas are required, a wholesale restructuring of the procedures is not necessarily required. But I do look forward to changes that improve the balance between patentees and challengers.

Celebrating 15 Years of IPWatchdog.com

On October 10, 1999, I remember sitting at my desk in my apartment in Winter Park, Florida. I had just starting teaching as a full time law school professor several months earlier. So many things have changed since then. I’ve moved all over the country, I’ve traveled all over the country, I’ve gotten married, we navigated the near collapse of the U.S. economy and like so many, the near collapse of our personal economy. My mother passed in 2012, which was undoubtedly the lowest moment in my entire life. A year later my father-in-law also passed. While there have no doubt been trying times, we have shared many great moments personally, and with those in our community who have become our friends. But since October 10, 1999, the one constant for me has been IPWatchdog.com, which went live for the first time 15 years ago today.
