House Subcommittees Hold Hearing on China’s Predatory Trade, Investment Strategy

The day’s hearing featured discussion of actions the U.S. government should be taking in order to counter deceptive trade practices pursued by the Chinese government, a topic which has become a main theme of the administration of President Donald Trump… Despite initiatives like the Made in China 2025 program, there’s no way for the Chinese economy to get close to catching up to the United States’ competitive advantage in many industries over the next 20 to 30 years without cheating by stealing innovation according to panel witness Robert Atkinson, President of the Information Technology and Innovation Foundation. Atkinson argued in his opening statement for a stronger antitrust regime to go after specific Chinese firms, such as rules prohibiting Chinese firms that have stolen U.S. IP from using our nation’s banking and financial systems.

The Cost of Registering a Trademark in Southeast Asia

Typically, there are three categories of costs involved in filing trademark applications in Southeast Asia and, subsequently, getting them registered; these are official fees, attorney charges, and translation costs. As is the case with the other types of trademark costs, the costs are generally dependent on the number of classes of goods and services under which the trademark applications are filed. The ‘International Classification of Goods and Services’ contains 34 classes for goods and 11 classes for services.

President Trump to meet Xi Jinping in Beijing during Asia tour

In mid-August, the Trump Administration announced that it would probe the alleged theft of U.S. intellectual property as aided by the Chinese federal government. One could assume that this probe might be a topic of conversation. During this conversation President Trump should ask President Xi to explain how a Communist regime is capable of having a better understanding of the importance of protecting patent rights than a nation ostensibly built on private property rights; a nation that has previously been the bastion of capitalism through the 19th and 20th centuries.

Patenting Costs in ASEAN: Upcoming Global Economic Powerhouse

Founded in 1967 by Indonesia, Malaysia, the Philippines, Singapore, and Thailand, the Association of Southeast Asian Nations (ASEAN) is a regional organization that aims to “accelerate economic growth, social progress, and sociocultural evolution among its members.” The organization’s membership has subsequently expanded to ten, with the induction of Brunei, Cambodia, Laos, Myanmar, and Vietnam. Collectively, the ten economies constitute an economic powerhouse; the ASEAN Economic Community (AEC) was the third largest Asian economy and the seventh largest global economy in 2014, as per the ASEAN website. Further, the AEC is expected to grow at a feverish pace of 7% per annum and is touted to be the fourth largest economy in the world by 2030 (Ken Moriyasu; 2016).

Michael Jordan prevails in trademark case, earns right to use Chinese character mark for his name on merchandise

On December 8th, famed basketball star Michael Jordan was partially successful in a legal action filed in Chinese courts over the use of his name and likeness on shoes and sportswear marketed by a domestic Chinese firm. The case is further proof of a major change in the fortunes of foreign intellectual property owners in the highest courts of the world’s second-largest economy. The Jordan trademark suit goes back to 2012 when the suit was filed against Qiaodan Sports, a sportswear manufacturer operating thousands of retail locations in China which was founded in 2000 according to business information reported by Bloomberg.
