Judge Rules That Script for “Friday the 13th” Was Not a Work For Hire, Allows Scriptwriter to Reclaim Copyright

District Judge Stefan Underhill of the District of Connecticut issued a ruling on cross-motions for summary judgment in a copyright case involving the cult horror film Friday the 13th. Judge Underhill’s ruling determined that Victor Miller, the screenwriter who wrote the script for the movie, did not produce the script as a work made for hire, thus preserving his ability to claim ownership of the copyright for the script.

Why the IP system works against the small

The decision whether to secure technology using a trade secret or a patent hinges as much on the technology as it does on access to capital. Small companies need funding to commercialize new inventions. A patent provides a private property right that can be leveraged to attract funding. However, most large companies like Waymo, one of the richest on the planet, do not need funding. This is no doubt why Alphabet and its Google subsidiary have lobbied to weaken the patent system. It is understandable because it is in the best interests of their well-funded enterprises. It is, however, not in the best interest of innovation more generally speaking, nor is it in the interest of society… The IP system as it currently exists acts to protect huge monopolistic enterprises at the expense of everyone else – employees, startups, job creation, innovation, and society at large. India sends over the vast majority of H-1B visa workers in America

India, the world’s second-largest country by population, sends the most foreign workers to America on H-1B visas for specialty occupations by a wide margin. Statistics reported by the U.S. Department of State show that in 2012, 80,630 H-1B visas were issued to workers coming from that country. In second-place that year was China, which sent a total of 11,077 workers over on an H-1B visa; these numbers include submissions of visa extensions which don’t count against the annual cap of 85,000 new H-1B visas.

A Provocative Idea That Turns Out to be Wrong
