Zeidman Technologies Sues U.S. Over Unlawful Abuse of Discretion in SBIR Grant Process

In the lawsuit filed in the Court of Federal Claims, Zeidman Technologies alleges that the U.S. government gave three conflicting and contradictory explanations as to why Zeidman’s proposal for the SBIR request was denied, despite the fact that Zeidman owns patented technology that specifically met the requirements of the request. These rejection explanations also allegedly relied on criteria that were not explicitly stated in the SBIR request for proposals, resulting in what Zeidman argues was an arbitrary decision.

Mark Cuban: “Get rid of all software patents”

A dim view of software patents does not make Mark Cuban unique, but his latest foray into the patent debate does provide interesting insights into his arbitrary views on innovation. Like your technophobic grandfather, Cuban seems to believe that innovators are entitled to patent rights as long as the innovations are tangible. When those innovations manifest themselves in the form of intangible software the underlying innovation is for some reason no longer entitled to patent protection. Surely Cuban has to realize that this self balancing scooter could accomplish the same exact functionality if the control logic were software based, right?

False Distinctions Between Hardware and Software Patents are Not the Answer

From an end-user’s perspective, it shouldn’t matter whether the normalization is done in hardware, in software or in a combination of hardware and software. And from the perspective of an interface designer, one would expect to be able to protect an invention that takes raw data from human input and causes a computer to scroll “intuitively” irrespective of whether implemented in hardware, software or a combination thereof. But therein lies our current §101 case law predicament.
