Clawing Deeper into the Monster v. Raptors Trademark Battle

Torontonians may have accepted the loss of Kawhi Leonard, but another Raptors asset is still at risk: their newest logo. As detailed here, the Raptors are tipping off against energy drink company, Monster, who allege the Raptors’ logo—featuring a clawed-up basketball—is confusingly similar to their own claw-mark logo. Since first filing their United States trademark opposition suit in 2015, Monster has continued their court battle against the Raptors for the last four years with no known resolution to date. Monster has a whopping 176 trademarks active in Canada at this time. Their most recognizable and widely used mark contains three jagged vertical gashes, resembling those from a claw, in the shape of the letter M. Since 2002, Monster has used the claw-like logo on everything from their beverage products, to event sponsorships, to clothing. The Raptors, on the other hand, have only been using their clawed-up basketball logo since 2014, when they underwent a brand redesign, and do not own a federal trademark registration for the rebranded mark in Canada.

Senators Discuss Counterfeits at GIPC, INTA Forum for World IP Day

On Thursday, April 24th, I attended a Sports Industry briefing and cocktail reception in honor of World IP day.   The program was sponsored by the U.S. Chamber of Commerce Global Innovation Policy Center (GIPC) and International Trademark Association (INTA). The program featured a panel of policymakers, including US Intellectual Property Enforcement Coordinator, Vishal Amin, and Congressional Trademark Caucus Co-Chairs, Senator Chris Coons and Senator Chuck Grassley as well as Attorneys who represent the MLB, NBA, NFL, NHL, and IMG College Licensing.

Jägermeister files trademark opposition with TTAB over similar Milwaukee Bucks logo

In April 2015, the National Basketball Association’s Milwaukee Bucks announced that it was in the midst of a project to redesign the team’s logo. Reports indicated that the logo would retain a version of the deer’s head which had graced the team’s previous logo, but with a new green and cream color scheme… The TTAB petition filed by Jägermeister identifies a series of eight U.S. trademarks held by the liqueur maker as grounds for opposition to the Bucks’ ‘186 trademark application. The vast majority of these marks have only been registered for use in trademark class 33 which covers alcoholic beverages except for beers.
