How to Participate in Open Source While Maintaining IP Integrity

The key idea is to think strategically about the software, the value it can provide to the company, and whether the technology should be developed in-house. In some cases, software can provide more value to the company when it includes open source components. Here at Dropbox, for example, we use open source software in our products and we use it to help with development… Even here there are a few ground rules: We evaluate the code on the way in so we know what has been incorporated in our software later. And we prohibit code that is licensed under more restrictive terms that could require us to open source our product in turn.

Google open innovation powered by efficient infringement

Given the growth of efficient infringement, Google can operate in an open innovation way, applying open source principles to patented technologies from outside of the company as well as from those inside the company and partners… If it were not for efficient infringement it would be impossible for one company to be involved in as many different areas of endeavor as Google/Alphabet have attempted. The only feasible way for them to hunt for the next revenue stream seems to be to scatter-shot innovation by going in numerous different directions without any real focus. Of course, that requires them to ignore the rights of others and pretend we live in an open source world without any patent rights. Ironically, it is this disparate and uncoordinated approach to innovating that is also preventing Google from developing any kind of mastery outside of their core search competency and revenue generating model.

Open Innovation is the Answer for the U.S. Economy

Innovation and how to foster next generation technologies is a topic of very active discussion within businesses across the country. But how can America continue to be one of the most innovative countries in the world? The rapid adoption of IP management and licensing platforms built around social collaboration seems to lead us to one answer – open innovation. Indeed, with today’s technology allowing for the seamless transfer of information – R&D departments have little to no choice but to begin to embrace the open innovation model and use it to their advantage. Understanding your intellectual assets and being able to capitalize on them in order to generate more revenue must be an important part of managing IP and fostering innovation.
