Tillis Forges Ahead with Effort to Create a Unified IP Office

In January of this year, Senator Thom Tillis (R-NC) sent a letter to Matthew Wiener, Acting Chairman of the Administrative Conference of the United States (ACUS), and Todd Rubin, ACUS Counsel for Congressional Affairs, asking that the ACUS “conduct a study on whether Congress should create a unified, stand-alone, and independent Intellectual Property Office.” But Wiener replied to Tillis’ letter on March 7, indicating that ACUS “has neither the expertise nor resources to conduct” such a study. Instead, Wiener suggested asking an entity better positioned to undertake the task, such as the National Academy of Public Administration (NAPA), which Tillis wrote to today.

Scholars, Register of Copyrights Reinforce Opposition to American Law Institute’s Restatement of Copyright Project

The American Law Institute (ALI) is under fire this week for its Restatement of Copyright Law project, which it was set to vote on during its Annual Meeting this week. According to the Copyright Alliance, ALI members on June 8 approved many sections that will make up the first three chapters of the Restatement. In 2019, members of Congress sent a letter expressing serious concerns over the project. Senator Thom Tillis (R-NC) and Representatives Ben Cline (R-VA), Martha Roby (R-AL), Theodore Deutch (R-FL) and Harley Rouda (D-CA) sent a letter to ALI stating that laws created through federal statute like copyright are “ill-suited for treatment in a Restatement” and threaten to muddle the law. The U.S. Copyright Office, the American Bar Association (IP Law Section) and the U.S. Patent and Trademark Office raised similar concerns.

USPTO Appoints Mary Critharis Acting Chief Policy Officer and Director for International Affairs

Yesterday, the United States Patent and Trademark Office (USPTO) announced that Mary Critharis has been appointed as the USPTO’s Acting Chief Policy Officer and Director for International Affairs. According to the announcement, Critharis will serve in the role while the USPTO continues the process of identifying a permanent replacement for Shira Perlmutter, who was the Chief Policy Officer and Director for International Affairs for the past eight years. Last month, Perlmutter was chosen by Librarian of Congress Carla Hayden to be the 14th U.S. Register of Copyrights. 

Shira Perlmutter to Head U.S. Copyright Office

The U.S. Patent and Trademark Office (USPTO) announced today that Shira Perlmutter, the Office’s Chief Policy Officer and Director for International Affairs, has been chosen by Librarian of Congress Carla Hayden to be the 14th U.S. Register of Copyrights. Maria Strong has been serving as Acting Register since January 2020, after former Register Karyn Temple left the position in December 2019. Temple had been promoted to Register in March 2019 following two and a half years serving as Acting Register. Maria Pallante, the 12th Register of Copyrights, had been fired from the position in 2016.  

Industry Insiders Make Patent Wishes for 2014

Manny Schecter (IBM Chief Patent Counsel) writes: “Last year I wished for greater understanding of the patent system outside of the patent community. Awareness of the patent system has certainly grown, but understanding? I’m not so sure. I still see a rush by many to hasty “solutions” that would actually result in more harm than good. My latest concern is proposals for technology-specific reforms. These proposals comprise calls for restricting the scope of, enhancing challenges for, or eliminating altogether, patents relating to certain technologies such as computer and genetic implemented inventions.”

Reflections on 2013 and Some Thoughts on the Year Ahead

2013 turned out to be a very big year for IP, and especially patents, and the year took a course that few would have predicted this time last year. At that time, the senior team at the PTO was primarily focused on the imminent departure of our then-boss, David Kappos, and the end of what had clearly been an extraordinarily active and successful tenure. The AIA had been almost entirely implemented, the new Patent Trial and Appeal Board was up and running, and most of us expected 2013 to be focused on implementation and execution of the AIA and the other initiatives that had been set in motion under Director Kappos.
