Each state has its own unique rules pertaining to trade names that are very close, if not identical, to the federal rules. It naturally follows, then, that an application for a Florida state trade name for a sushi restaurant is a pretty boring subject. Unless the applied for mark is “Fuku” and the application is rejected on the grounds that the mark is scandalous.

USPTO Announces 2012 National Trademark Expo

The United States Patent and Trademark Office (USPTO) will host the 2012 National Trademark Expo on Friday, Oct. 19, and Saturday, Oct. 20, at the USPTO’s headquarters in Alexandria, Virginia. The free two-day event is designed to educate the public about trademarks and their importance in the global marketplace. Last year’s Trademark Expo attracted more than 15,000 visitors of all ages.

More Cybersquatting on the Horizon with Launch of New gTLDs

On January 12, 2012, the Internet Corporation for Assigned Names and Numbers, more commonly known simply as ICANN, began accepting applications for new gTLDs. Until March 29, 2011, entrepreneurs, businesses, governments and communities around the world can apply to introduce and operate a generic Top-Level Domain of their own choosing. Currently there are approximately two dozen gTLDs, but as the result of ICANN’s decision to expand the number of gTLDs there could be hundreds in the not too distant future.

Does the First Amendment Protect False and Misleading Speech?

Yes, I had the audacity to say what is objectively correct. There is no absolute right under the First Amendment to engage in false or misleading speech. Despite the fact that this statement is legally 100% correct you would have thought I was engaging in treasonous behavior. What made it all the more comical was that it was the anarchists who seemed most upset, both in comments on IPWatchdog and in a variety of Twitter and blog articles that sought to paint me as some kind of crazy. You see the anarchists got so upset because the only play in their playbook is to lie and misrepresent in order to pull the wool over the eyes of enough people that they can get their way. That is where America is currently and if you ask me that is wholly unacceptable.

Trademark Skullduggery: Lawsuit Challenges Publication Service

Leason Ellis LLP, an intellectual property law firm located in White Plains, New York, recently filed a complaint against USA Trademark Enterprises, Inc. of Sarasota, Florida. The multi-count Complaint alleges that USA Trademark Enterprises has engaged in false advertising and unfair competition by marketing a catalog of trademark registrations, which offers no value because the published information is freely available in the online records of the U.S. Patent and Trademark Office. David Leason, Managing Partner of Leason Ellis, said “by targeting our clients and us, USA Trademark Enterprises has interfered in our business and cast a shadow over the legitimacy of trademark-related communications. In filing suit, we are out to protect our clients, our business, and the integrity of the trademark process from predatory and deceptive marketing.”

7 Common Misperceptions About Intellectual Property

As an aside, and somewhat related to the boring concept, is the idea that intellectual property practitioners are all basement-dwelling nerds. OK, maybe we’re a little nerdy in some ways, but I swear I do not live in a basement, my summer reading did not include the cheat guide to World of Warcraft, and I have NEVER been to Comicon. So what if I have the blueprints to the Millennium Falcon on my office wall and my favorite TV show is “How it’s Made”? You gotta admit some of the stuff we get to do and see in our professional lives is pretty freaking cool. The seediest infringement cases. The bleedingest edge of technology. The next rival to the power of McDonald’s logo or Coca-Cola trade secret. I wear my nerd moniker proudly.

Internet Trademark Law 101: Don’t Metatag Me, Bro!

People have been arguing about the Internet since Al Gore invented it (sorry, I just couldn’t resist). One would think this issue would have been well settled by now but it’s not. The courts are starting to move toward some sort of congruency but there is still a very decided split in the decisions. And, as with oh-so-many issues in intellectual property, there is a litany of case law on the subject and not one bright line rule. It all boils down to what we consider a “use in commerce” and if we can call that “use” a source of confusion in the consumer. Briefly, in order to make a claim of trademark infringement stick, you have to show the defendant used your mark in commerce and you have to show that that use likely confused the purchasing public as to which company was actually selling that service or those goods. Since a metatag isn’t technically visible on the web page, federal courts haven’t agreed whether a metatag is “used or displayed in the sale or advertising of a service rendered in commerce or “placed in any manner” on a good transported in commerce”. Kellogg’s Toucan Sam Asserted Against Archaeology Initiative

According to the Maya Archaeology Initiative press release, a detailed response was sent by their legal representative to Kellogg’s, which among other things asserted that the toucan in MAI’s logo looks nothing like Kellogg’s cartoon character and said the two entities are not in competition. The press release goes on to say that the MAI’s logo is based upon a realistic toucan native to Mesoamerica, while Kellogg’s Toucan Sam is a cartoon character with colors that represent the Froot Loops® food coloring. Really? Wow! Let’s take those one at a time.

Opportunistic Disney Seeks to Trademark “Seal Team 6”

The Navy filed two applications for trademarks on May 13th. The first is application serial number 85320305 for “Seal Team”. The identified class is “membership in an organization in the Department of the Navy”. By the way, there are 8 Navy SEAL teams that we are aware of, which may be one explanation for the application for just “Seal Team”, as opposed “Seal Team 6”. The other is serial number 85320473 for “Navy Seals” to be used on posters and clothing. Both applications are section 1(a), meaning the Navy is currently using the marks in commerce, and has been for quite some time. The Navy also owns the trademark registration “Seal” (registration no. 3285473), which indicates “membership in an organization of applicant that develops and executes military missions involving special operations strategy, doctrine, and tactics.”

Protecting Your Intellectual Property in China

The China Road Show is a series of two-day China IP events that the USPTO is hosting across the country to help educate businesses about the realities of piracy and counterfeiting—which cost the American economy approximately $250 billion annually. Day 1 is largely devoted to understanding the patent, trademark and copyright laws in China, as well as enforcement of those rights. Day 2 of the seminar will address § 337 Infringement Investigations by the International Trade Commission (ITC), the challenges presented by counterfeiting and piracy on the Internet and the development of global IP strategies even for small businesses.

Intellectual Property Protection in China is NOT an Oxymoron

Believe it or not, Patents are enforceable in China. Trademarks are enforceable in China. Copyrights are enforceable in China. The devil is in the details. Certainly if you are trying to enforce your patent against a company in the boondocks far west of Chengdu, and that company happens to be the largest employer in the district, then you are going to have problems. No one can / should tell you differently. However, can you tell me with a straight face that these same problems would not occur in the US if the situation was reversed – where a foreigner is asserting a patent against a local, respected employer in a rural area of the US?

NFL Players vs. Owners: A Hail Mary of a Lawsuit

About 10 years ago, the NFLP decided that they wanted Reebok (and only Reebok) to make hats with the teams’ logos on them. American Needle, Inc., a competitor of Reebok, had been making these types of hats for the NFL for a really long time, and as a result of the NFLP’s deal with Reebok, it lost its contract with NFLP to make said hats. American Needle, Inc. did not have much of a sense of humor about this and sued the NFL under Antitrust principles. Enter American Needle v. National Football League et al. Needle is a big case because if the NFL had gotten what it asked for, the player’s union wouldn’t have been able to decertify and the players wouldn’t have been able to bring an antitrust suit.

ICANN to Begin Accepting Applications for New Generic Top Level Domain Names (gTLDs) in 2011

In June 2008 ICANN (the Internet Corporation for Assigned Names and Numbers), a non-profit technical coordination body for the Internet’s name and numbering systems, made headlines when it announced that it would allow an unlimited number of new gTLDs (generic top level domain names) to populate the web. While the process has been delayed several times, the current belief is that ICANN will begin accepting applications for these new gTLDs by July or August of 2011. However, many in the industry expect the start of the application process to be delayed further, as various trademark organizations have raised concerns about the award and dispute resolution process.
