Software Patent Eligibility: How to Articulate a Patent Eligibility Invention

In the United States software is patentable. While it is often said that over the last several years it has become increasingly difficult to obtain software patents in the U.S., it is probably more accurate to say that while it has become increasingly difficult to obtain these patents it has become even harder to keep these patents once they are issued. As a result of the Supreme Court’s decision in Alice v. CLS Bank it seems that federal district courts, the Federal Circuit and the Patent Trial and Appeal Board find computer implemented innovations to be patent ineligible abstract ideas with astonishing frequency. This webinar will review the most recent decisions of note relating to patent eligibility of computer implemented inventions, and offer strategies for describing these inventions so they can both pass muster at the Patent Office and stand the test of time in the courts and at the PTAB.

Join Gene Quinn, patent attorney and founder of IPWatchdog.com, Bart Eppenauer, former Chief Patent Counsel for Microsoft and current Managing Partner of Shook, Hardy & Bacon’s Seattle Office, and Kirupa Pushparaj, Director of Intellectual Property at Square.

Policing Trademarks Worldwide to Maintain Brand Integrity and Protect Against Counterfeits

Trademark infringement can be a big issue, but increasingly the biggest issue is not merely an act of infringement associated with a competitor going to far or getting too close, but rather with criminal enterprises engaging in widespread counterfeit operations. By some estimates the global cost of counterfeiting has risen to nearly $2 trillion dollars. Counterfeiting is becoming a plague on the world economy.

Join Gene Quinn for a wide-ranging discussion of the growing epidemic of counterfeiting, and tried and true mechanisms for policing trademarks in the real and online worlds.
