Patent Filings Roundup: Fertilizer, Fitness Tracker and Phone Fights

District court patent filings are up again this week, demonstrating that even a good lockdown can’t keep patent lawyers down; indeed, it appears there’s no sleep for the weary, given the spike in non-practicing entity (NPE) assertions and a fair amount of medium-sized company-to-company litigation, as well as a brewing dispute between Philips and Fitbit on wireless fitness trackers.

Fertilizer fight: Iowa is known for many things: vanguard political primaries, being America’s breadbasket, seemingly empty baseball fields, and (for me) one particularly memorable teenage visit to the Corn Palace on a Church Group trip. Now it is also the locus of MicroSource, LLC et al. v. Eco World Group, LLC, a DJ patent fight from last April over “Liquid Formulations of Urease Inhibitors for Fertilizers.” MicroSource is a fertilizer company owned by Gavilon (a Brazilian company), which appears in turn to be owned by Marubeni Corporation, a Japanese sprawling organization. Eco World Group, LLC is a Wyoming company registered in 2018 at a building that has been accused of setting up “paper companies” and is related to Eco Agro, LLC, based in Florida. Solvay USA filed earlier post grant review (PGR) was filed on one of the patents; now Solvay has filed IPR2020-00768 on the same. It’s not immediately clear how Solvay is related, if at all, to MicroSource.

Livin’ on the Edge: A number of IP Edge suits heated up or saw a fair number of filings this week; Round two of Valyrian IP LLC on a former Siemens patent relating to a cordless phone system that forwards calls from a base station to handsets based on priority, this time suing Sangoma; RingCentral, AT&T, SpectrumVoIP, and Verizon in various districts; previously (July 2019) they sued ICON Voice Networks, Plantronics, Granstream Networks, and Avaya. Further rounds of assertions in Sonohm Licensing LLC add to earlier campaigns against Tangent Computer with March suits against Avalue Technology CONTEC, MilDef, Nex Computers, Superlogics, and VTech Holdings (Leapfrog Enterprises), among others. IP Edge as opened new campaigns for filed new complaints in the Tekvoke, LLC, Aristors Licensing LLC, and Hydro Net, LLC, Pearl IP, Encoditech, LLC, campaigns.

Every step you take, I’ll be watching you: A sprawling International Trade Commission (ITC) fight over fitness trackers has spilled into the Courts and the Patent Trial and Appeal Board (PTAB). In December, Philips brought a complaint at the ITC seeking to block imports (and prevent any further sales, manufacture, or use in the United States) of all of their popular wireless trackers over infringement of Philips3 patents and based on its domestic industry of its “Lifeline,” “Motion Biosensor,” “Connected Sensing,” and “Sleep Diagnostics” products. This week, Fitbit fired back, filing DJ action in California on three patents, accompanied by some five inter partes reviews (IPRs) (either alone or in conjunction with Garmin). Philips has yet to walk back any of its complaints. As it were.
