Patent Filings Roundup: ‘Something in the Water’ with Sharp Spike in District Court Filings

While Patent Trial and Appeal Board (PTAB) filings were up slightly (the spike due entirely to 14 new petitions from Comcast against Rovi in their massive ongoing licensing dispute), the district courts—particularly the Texas branches—had a banner week, with 127 new patent filings—54 of which were filed Friday, April 24 alone. The majority, 31, were filed in Texas courts.

Good Friday? The 54 new complaints included a spate of filings by entities controlled by IP Edge and Leigh Rothschild, more VoIP-PAL suits, and some high-profile standard-essential patent infringement cases by Conversant Wireless against Tesla. They also included 16 new suits filed by a new entity, as described below.

Watertight case: Inventor-controlled litigation vehicle Kirsch Research and Development, LLC (Mark C. Strait) on Friday, April 24, 2020 sued 16 mostly U.S. manufacturing companies that make and sell roof liners in the Eastern District of Texas, the Northern District of Texas, and in Pennsylvania’s Eastern District, including Certainteed Corporation, DuPont, Intertape Polymer Corporation, Owens Corning, IKO Enterprises Limited, Bluelinx , Atlas Roofing Corporation, GAF Corporation, TAMKO Building Products LLC, Continental Materials Inc., Tarco Specialty Products, Inc., Underlayment Specialties Plus, LLC, IKO Industries, Inc., Epilay, Inc., FT Synthetics Inc., Dorken Systems, Inc., System Components Corporation, and InterWrap Corp. The two patents asserted, 6,308,482 and 8,765,251, claim a “Reinforced roof underlayment and method of making the same.”

Long time coming: It has been almost three years since Allergan partnered with the Saint Regis Mohawk Tribe in an attempt to avoid review of their patents in both District Court and the PTAB, prompting widespread condemnation and triggering Congressional attention. The idea—renting the sovereign immunity of an indigenous American sovereign nation to shield patents from invalidity review—failed spectacularly. While the District Court found it was a sham and the PTAB, Federal Circuit, and members of Congress introduced bills specifically targeting the scheme, it did have major implications for a less contrived situation—that where a state university, for instance, holds patents and seeks to shield itself from review. Those challenges were likewise unsuccessful, the Federal Circuit affirmed the ruling last summer, and they have now been denied certiorari (as of January this year). The PTAB, in a highly unusual move, stayed those petitions while the issue went up the Federal Circuit, and has now ruled on the petitions filed three years ago, styled Gilead Sciences, Inc. v. Regents of the University of Minnesota. The Board denied all three petitions on other grounds, which suggests that, had Minnesota not sought the stay and challenged the ruling up to the Federal Circuit and the Supreme Court, they would have had the cases settled years ago without these wasted resources. Of the challenges, two covered the same patent. The Board denied all three over a dissent from one of the panel, who argued that the majority inappropriately resolved a factual dispute in favor of the patent owner to reach an unmeritorious denial.  The dissent argued:

The majority, however, does not analyze the arguments that are presented in the current Petition. Instead, the majority focuses on whether additional prior art . . . provide a sufficient motivation to substitute fluorine at the 2’ down position. … I do not believe Petitioner has a burden to preemptively address those prior art teachings in the Petition itself. Nor would I resolve the type of factual dispute that the majority does in Patent Owner’s favor at this preliminary stage in the absence of a full evidentiary record.

    Mr. Corcoran,

    Be that as it may (and I certainly ignore most things that smack of his work with Unified Patents – including the type of laundry list of items that make up the general series of which this post may be included in), there ARE items worth engaging upon.

    For immediate example, the legal notion of a sham as a term of art carries with it specific meaning that does not attach to what the courts have written of any such contractual relationship at point here.

    Mr. Stroud, as an attorney would do well to heed this type of feedback. Certainly, he already has a battle with segments of the population that will tar the messenger as bearer of a message. However, there are also attorneys aplenty that read this blog, and that recognize that an attorney is distinct from his clients. These attorneys will lower their professional regard for Mr. Stroud’s veracity when the tactics of ‘yellow journalism’ or slack emotional hype interfere with a legal concept.

    Which is MY point – use of the term “sham” is simply not appropriate, as that term has a specific legal meaning.

    My point at 1 stands.

    From Judge Bryson’s ruling:

    “The Court has reviewed the information and briefs filed in response to the Court’s order.

    From that information, it is clear that Allergan’s motivation for the assignment was to attempt to avoid the IPR proceedings that are currently pending in the PTO by invoking the Tribe’s sovereign
    immunity as a bar to those proceedings.
    The Court has serious concerns about the legitimacy of the tactic that Allergan and the Tribe have employed. The essence of the matter is this: Allergan purports to have sold the patents
    to the Tribe, but in reality it has paid the Tribe to allow Allergan to purchase—or perhaps more precisely, to rent—the Tribe’s sovereign immunity in order to defeat the pending IPR proceedings
    in the PTO. This is not a situation in which the patentee was entitled to sovereign immunity in the first instance. Rather, Allergan, which does not enjoy sovereign immunity, has invoked the
    benefits of the patent system and has obtained valuable patent protection for its product, Restasis.

    But when faced with the possibility that the PTO would determine that those patents should not have been issued, Allergan has sought to prevent the PTO from reconsidering its original issuance
    decision. What Allergan seeks is the right to continue to enjoy the considerable benefits of the U.S. patent system without accepting the limits that Congress has placed on those benefits through the administrative mechanism for canceling invalid patents.
    If that ploy succeeds, any patentee facing IPR proceedings would presumably be able to defeat those proceedings by employing the same artifice.”

    To be sure, while he calls it a “ploy” and an “artifice”, but the issue of sham wasn’t directly before him in this paper, and his ruling of invalidity of the patents mooted any concern in District Court. But I’m just doing with Judge Bryson’s view here, which I don’t think is controversial any longer.

    The letter to the PTO last week suggests that at least Senators Tillis and Leahy are still concerned with that type of thing.

    Mr. Stroud,

    You have an error. In regards to the St. Regis Mohawk matter, the lower court did NOT hold that the deal was a sham.

    Sham is a legal term of art with a very clear meaning. The court expressly did not reach that meaning.

    Many may not like what was attempted. Let’s not let this be a popularity contest at the expense of proper legal meaning.
