Patent Filings Roundup: Landmark Brings 250th Complaint; Medtronic and Infinera Fall Victim to Board’s Discretionary Denial Parallel Petition Rule

It was a relatively quiet week in the District Courts, with just 52 new patent complaints filed and 28 petitions, two post grant reviews (PGRs) and 26 inter partes reviews (IPRs). This week included Amazon filing four petitions against Freshub scanner patents; Verizon filed a number of petitions against Huawei, presumably in response to their widely publicized billion-dollar licensing demands; Dolby filed against Intertrust patents; there was plenty of continued IP Edge activity; but otherwise, a relatively quiet week; that said, the following week’s numbers (which stop at Monday’s reporting) contain a slew of new cases by Bausch and Lomb, as well as a phalanx of 15 WSOU complaints on fifteen independent patents not previously litigated, all in individual complaints, all in the Western District of Texas, and all against Google.  It seems clear now (more on this next week) that WSOU, which is run at least in part by Craig Etchegoyen of Uniloc fame and represented by Uniloc’s counsel the Etheridge Law Group, appears to be taking a page from Uniloc’s book circa 2015, in that they have now sued five companies on 12-15 patents each, in staggered fashion, in districts both perceived and marketed to be litigation-friendly.

Landmark’s Milestone: Well, it happened.  Lawrence Lockwood’s Landmark Technology (and the reconstituted sub, Landmark Technology A) have now brought suit against more than 250 companies, ranging from the very large [Laz-y-Boy, Radio Shack] to the mostly very small [The Three Dog Bakery, Rock Valley Tractor Parts, Charlie’s Pastries] to the ethically questionable [Thrift Books, various healthcare websites] to the truly bizarre [Build-a-Bear Workshop, Blockbuster]. The progenitor patent, filed in 1984, underwent truly tortuous examination at the office and emerged in 1996. The second had the coincidentally ignominious issue date of September 11, 2001, and thus expired in 2018. But expiry hasn’t slowed Mr. Lockwood’s roll, and he continues to file (and presumably will continue to do so until 2024, six years after expiry). The first patent was challenged and instituted into a covered business method (CBM) review proceeding, but settled way back in 2014; it hasn’t prevented Mr. Lockwood from continuing to be what is likely one of the—if not the—most prolific single-entity filers.

More 314 Denials: This week it was Medtronic’s turn to have petitions turned away without being considered. In IPR2020-00131, the Board denied Medtronic’s second parallel petition under their July 2019 Trial Practice Guide Update, as reflected in the November consolidated TPG.  Here, Medtronic filed four petitions, two on one set of mostly overlapping claims (1–4, 6–10, 12–21, 23 in one, 1–4, 6–9, 12–21 in the other), and two on the other set (claims 25-39).  Each of the two sets relied on different prior art.  The Board found that the second petition of both sets (as ranked per the July TPG update’s requirement) did not merit consideration and denied those challenges.

For Infinera Corporation, it was more of the same; the Board denied their second-filed parallel petition, denying IPR2020–00326 against Oyster Optics, LLC outright.  The difference for them was that their petitions challenged different claim sets; the instituted IPR challenged 1, 2, 4–9, and 17–19; the denied IPR challenged just claim 16. Nonetheless, the Board denied it under the July TPG Update.

    So contrary to the title of the post, 100% of the patents challenged by Medtronic were instituted? The gaming of the system by PTAB and their favorite corporate customers is scandalous.

    The fact that a patent has been challenged as a CBM doesn’t mean it is invalid and the owner has to stop asserting it. What seems to upset Mr. Stroud and his UP buddies so much is that patents are being asserted and that IPRs are being denied.

    But, it is always with great pleasure that I read the UP misery list on IPWatchdog and learn about potential investors who acquire patents.
