Part 2: Research Roundtable on Standard Essential Patent Determination Approaches

The uncertainty regarding the essentiality of declared SEPs is an important topic in the policy debate about FRAND. Different approaches have been proposed to increase transparency about the number of truly essential patents in different patent holders’ portfolios. As assessments of the proportion and number of truly essential patents owned by different patent holders play an important role in FRAND determinations, it is crucial to understand the diversity of existing approaches, and how to properly interpret their results. The December 8th 4 pm CET/ 10 am EDT discussion will start with an introduction by Adriana van Rooden, DG GROW, EU Commission, and will be moderated by Tim Pohlmann, CEO at IPlytics. The panel of invited experts includes:

  • Kirti Gupta, Chief Economist at Qualcomm
  • Jon Putnam, Competition Dynamics
  • Tim Simcoe, Associate Professor at Boston University
  • Lew Zaretzki, Hamilton IPV and LOT Network

The panel will debate about existing approaches to essentiality assessments discussing the merits of proposed new methods and potential policy measures. In the wake of the methodological aspects of different SEP determination approaches, the discussion will cover the governance and potential policy impact of essentiality rate calculations. In addition to the panel speakers a larger group of experts will be invited to the roundtable discussion to comment and ask questions.
