Heath Briggs

Heath Briggs is Shareholder and Global Co-Chair of Patent Prosecution at Greenberg Traurig, LLP with more than 17 years of patent prosecution experience and 9 years of AIA trial experience. Heath has represented a wide variety of clients in over 100 inter partes review proceedings (IPRs), with significant experience relating to LEDs, computer software/telecommunications, medical devices, complex material systems and chemical processing. In 2019, Patexia ranked Heath 29th out of the Top 100 Best Performing IPR Attorneys (representing Petitioners or Patent Owners), and in 2021 Heath was ranked the 43rd most active practitioner over the last 5 years.

Outside of the new post-grant review processes, Heath has worked on nearly 20 U.S. patent reexaminations (both inter partes and ex parte), and more than 35 European opposition proceedings for his clients.  Heath drafted the Patent Owner response that resulted in the PTAB’s Becton factors (Becton, Dickinson and Company v. B. Braun Melsungen AG, Case IPR2017-01586), and Heath was lead practitioner in the influential Samsung v. Prisua decision, holding the PTAB may invalidate claims on 102/103 grounds even though the claims are IPXL indefinite (Samsung Elecs. Am., Inc. v. Prisua Eng’g Corp., 948 F.3d 1342, 1354 (Fed. Cir. 2020).
