David Swenson Named Litigation Practice Chair at Patterson Thuente IP

MINNEAPOLIS —October 13, 2020Patterson Thuente IP is bolstering its full-service legal team with the addition of David P. Swenson, who has been named Litigation Practice Chair. Swenson has more than 25 years of experience successfully handling an impressive collection of IP matters involving patents, trademarks, copyrights, and trade secrets, as well as contract, product liability, employment, and other high stakes civil disputes.

Swenson’s experience includes patent-related matters in federal district courts around the country, the Patent Trial & Appeal Board (PTAB), International Trade Commission, Federal Trade Commission, and trial-format arbitrations covering myriad technologies from microchips, routers, Internet browsers, electronic commodity futures trading platforms, and aircraft anti-collision systems, to home faucet designs, unleaded gasoline formulations, and explosion-proof electric paint robots for use on automotive assembly lines.

A former judicial clerk for Judges Rich and Newman at the U.S. Court of Appeals for the Federal Circuit, Swenson also regularly handles patent appeals before the court. “I especially look forward to rounding out the firm’s services with the appellate wisdom I’ve gained throughout my career,” says Swenson. “Combining our backgrounds and talents, clients now have a full-service practice handling a broad swath of complex intellectual property matters.”

His notable appellate successes include convincing the U.S. Supreme Court to vacate PTAB inter partes review (IPR) decisions in Gramm v. Deere & Co. (2019); as well as victories in Extreme Networks, Inc. v. Enterasys Networks, Inc. (Fed. Cir. 2010); Imation Corp. v. Koninklijke Philips Elec. N.V., et al., (Fed. Cir. 2009); General Mills, Inc. v. Kraft Foods Global, Inc. (Fed. Cir. 2007); and, ACTV, Inc. v. Walt Disney Co.(Fed. Cir. 2003). He also wrote a key amici curiae brief to the Supreme Court for the winning side on behalf of IP Advocate, the IEEE, and the American Association of University Professors in Stanford v. Roche Molecular Sys., Inc. (2011).

Swenson received his J.D. from the University of Minnesota Law School, his M.A. in Public Affairs from the University of Minnesota, with a concentration in Energy, Technology & the Environment, and his B.A. in Computer Science from Boston College.
