Patexia Releases its First CAFC Intelligence Report and Rankings

Patexia’s 2021 CAFC Intelligence Report is the first in an annual series that provides rankings, statistics, and comprehensive analysis of CAFC stakeholders as part of its research division.

Santa Monica, CA (October 28, 2021): Today, Patexia, Inc., an IP analytics company and global IP community, is proud to announce its first annual CAFC Intelligence Report as part of its Patexia Insights series.

We realize that many law firms and attorneys struggle to distinguish themselves in the growing CAFC space, so we evaluated over 779 law firms and more than 3,904 attorneys on activity, success, and performance, enabling lawyers and practice groups to market themselves based on independent third-party rankings and proven results.

Additionally, this 99-page report can help corporations find the right CAFC counsel. Our rankings can be leveraged by these organizations to make better decisions based on proven records. Utilizing data from over 4,862 CAFC appeals filed over the past five years (January 1, 2016, through December 31, 2020), this comprehensive report ranks the law firms, attorneys, and companies according to their activity and performance.

Some interesting highlights from this year’s report include the following:

  • During the last five years, 4,862 CAFC appeals were filed.
  • 779 law firms have represented appellants and appellees. From this number, 440 firms represented appellants, while 613 firms represented appellees.
  • 3,904 attorneys worked for these firms; 3,216 attorneys represented appellees and 1,402 attorneys represented appellants.
  • For the period of our study, CAFC has engaged a total of 104 Administrative Judges.
  • Of  4,426 companies as appellants and appellees, Apple is the most active company with 259 appeals.

The report also includes a comprehensive analysis of yearly trends of CAFC cases, their originating courts, and statistical information about the outcomes.

When asked about this report and its importance, Pedram Sameni, the company’s CEO, relayed the following  “Patent-related appeals originating from the Patent Trial and Appeal Board (PTAB), International Trade Commission, and district courts account for a significant load of cases filed before the US Court of Appeals for the Federal Circuit (CAFC). This has increased the importance of CAFC for the intellectual property community and patent litigation. Up until now, we haven’t seen a comprehensive source that gathers all patent-related appeals including ITC, PTAB and district courts”.

He further added: “We hope this new addition to our Patexia Insight series fills the gap and provides useful statistics related to all parties involved in CAFC appeals and thus becoming a useful tool in the hands of companies, law firms, and attorneys.”

When discussing future plans, Sameni commented: “We expanded our offerings and now we cover seven unique areas in IP every year including ITC Section 337, Hatch-Waxman Litigation, District Court Patent Litigation, Patent Prosecution, Trademark Prosecution, Federal Circuit Court of Appeal (CAFC) and Inter-Partes Review”.

The CAFC Intelligence Report is available for purchase now at CAFC Intelligence 2021.
