Germany: Patent Law & Litigation
Approximately two-thirds of all European patent litigation cases are tried in German courts, which makes Germany an extremely important European venue for patent litigation.
German patent litigation bifurcates invalidity and infringement, with nullity actions handled by the Federal Patent Court and patent infringement matters concentrated by law to specific patent chambers in 12 district courts: Munich, Nuremberg, Mannheim, Frankfurt, Saarbrucken, Erfurt, Leipzig, Magdeburg, Dusseldorf, Braunschweig, Berlin and Hamburg.
Join us as we discuss German patent litigation, the practice in the most popular district courts, and what makes Germany an appealing venue to litigate patent disputes. The presentation will focus on the availability of monetary remedies for infringement, injunctive relief, the banning of importation, the awarding of attorney’s fees, willful infringement and much more.
