Gaming the Patent Litigation System: Value, Venue, Verdicts & Villains

CLEIt has been an interesting 12-24 months for the patent litigation system, to say the least. Once upon a time inside the beltway the topic of bad actors was dominated by talk of patent trolls, but with the return of so-called mega-verdicts (i.e., those in excess of $1 billion), the Patent Trial and Appeal Board (PTAB) has taken center stage as patent profiteers have filed challenges against those patents used to secure big verdicts. This has caught the attention of U.S. Senators, and the Director of the United States Patent and Trademark Office, as the weaponization of inter partes review (IPR) has some calling for a standing requirement to challenge patents at the PTAB. Will IPR filers with questionable monetary motives push Congress and/or the USPTO to act?

This discussion will focus on the role the PTAB plays in the larger patent litigation ecosystem, the future of mega-verdicts, and the wide-ranging issues that affect patent litigation in the United States as seen by our distinguished panel of experts.
