CLEOn December 31, 2021, Chief Justice John Roberts, of the United States Supreme Court, issued the annual Year End Report on the Federal Judiciary for 2021. In this report the Chief Justice highlighted three specific areas where the Judicial Conference will be taking action to study issues during 2022. One of the three areas related to patent litigation and the assignment of cases in the Western District of Texas. Indeed, through much of 2022, the caseload in the Western District of Texas has been front and center, with the Federal Circuit continually granting mandamus petitions and transferring cases, and now with the Chief Judge ordering that patent cases filed will be randomly assigned. Much concern has been voiced by critics of Judge Albright for the perception that his courtroom is patent owner friendly. Meanwhile, it seems nearly zero concern has been voiced by defendants constantly seeking to maneuver cases away from Judge Albright to courtrooms that are friendly to defendants.

This panel will explore the realities of litigating in all Texas districts, trends, and best practices, and discuss the big news of the moment relating to the future of patent litigation in the Western District of Texas.
