CLEThe Bayh-Dole Act is at the heart of technology transfer in America. The Bayh-Dole Act has empowered universities, small businesses, and nonprofits that have received federal grants to retain ownership of any patented inventions — and license those patents to private firms, who then turn promising ideas into real-life products that improve peoples’ lives.

The public-private sector collaboration bolstered by the Bayh-Dole Act has facilitated the creation of more than 480,000 inventions and 15,000 start-ups, while supporting nearly six million new jobs. Before Bayh-Dole, not a single new drug had been developed from NIH-funded inventions when the government took patent rights away from their creators. Since its enactment, approximately 300 new drugs and vaccines are now protecting public health world-wide.

Still, year after year the Bayh-Dole Act comes under assault from those who would like to turn back the clock. And federal laboratories have never enjoyed the same, full freedom to engage in licensing that Universities have.

What is the current state of technology transfer? What battles lie ahead during the second half of the Biden Administration.
