The Patent Cooperation Treaty is becoming an increasingly important tool for companies all around the world, with strategic use on the rise for a variety of reasons. Indeed, despite a global downturn due to the COVID-19 pandemic, the number of PCT filings grew in 2020 by 4%, and the number of PCT national phase entries grew by 4.3%. In fact, since the PCT began operating in 1978, the number of PCT applications has grown virtually every year, with the only exception coming in 2009 (and attributed to the global financial crisis). The PCT can, however, provide a minefield for practitioners only casually familiar with its many nuances.
