IP and Innovation on Capitol Hill: Week of March 18

This week in Washington, D.C., Capitol Hill is silent due to district work periods for the House of Representatives and state work periods for the Senate. However, the nation’s capital is still very busy with a collection of think tank events related to innovation and technology. A pair of events at New America looks at how technology and social media can stem the tide of extremist ideologies or how advances in DNA testing can help solve cold cases. Cybersecurity challenges at the next Summer Olympic Games are the topic of discussion at the Wilson Center. The Heritage Foundation also hosts a pair of events looking at how the Constitutional Framers viewed property and issues with China-based Huawei’s dominance in 5G. Closing out the week is a Friday event at the Information Technology & Innovation Foundation exploring challenges to the U.S. Postal Service in the e-commerce era.

Qualcomm, Google, Verizon and Industry Reps Gather for Women’s High-Tech Coalition Women of Wireless Dialogue

On February 13, global policymakers and technology company representatives gathered in Washington, D.C. at Google’s offices for the Women’s High-Tech Coalition (WHTC) Third Annual “Women of Wireless” dialogue. The speakers represented companies including Google, Verizon, and Qualcomm, as well as major industry organizations such as the Cellular Telecommunications and Internet Association (CTIA) and the Consumer Technology Association (CTA), and discussed the various infrastructure, policy, and privacy challenges facing the industry in the race to 5G-implementation. With a record number of women elected to the 116th Session of the U.S. Congress and recent White House Executive Orders on technology issues— including this month’s “Maintaining American Leadership in Artificial Intelligence (AI),” an expected executive order on 5G technology, and likely Congressional briefings and hearings focused on wireless innovation—the WHTC is an integral network of stakeholders to discuss these issues and to develop opportunities for strategic partnerships and shared initiatives.

Standard Essential Patents: The Myths and Realities of Standard Implementation

Standard Essential Patents (SEPs) are patents that are unavoidable for the implementation of a standardized technology. They represent core, pioneering innovation that entire industries will build upon. These patents protect innovation that has taken extraordinary effort to achieve. Standard Development Organizations (SDOs) exist as a mechanism for industry innovators to work together to collectively identify and select the best and most promising innovations that will become the foundation for the entire industry to build upon for years to come. Those contributing patented technologies to the development of a standard are asked to provide a FRAND (which stands for Fair, Reasonable and Non-Discriminatory) assurance, in essence committing to providing access to patents that are or may become essential to the implementation of the standard.

IP and Innovation on Capitol Hill: Week of February 4

This week on Capitol Hill, committee hearings in the U.S. Senate will focus on innovations related to financial systems, the race to 5G network connectivity and advances in energy-related technologies. In the U.S. House of Representatives, net neutrality makes its return as a hotly-debated topic, while the House Science Committee sets its rules for the 116th Congress, including the delegation of federally-funded research oversight to subcommittees. Elsewhere in Washington, D.C., the U.S. Chamber of Commerce releases the 2019 version of its International IP Index and the American Enterprise Institute hosts an event to look at the impact of technological advances on higher education.

ITC’s Chance to Restore Reason and the Public Interest in the Qualcomm v. Apple Case

An administrative law judge at the U.S. International Trade Commission recently found patent infringement in Qualcomm’s case against Apple, but then inexplicably refused to recommend that the commission issue an exclusion order against infringer Apple. Is there some new standard that “established and profitable companies” are no longer deserving of ITC action?  The International Trade Commission is in danger of causing the same harm to patent rights as the U.S. Supreme Court has inflicted on patent owners with the court’s lame-brained eBay decision.

Protecting IP Builds Confidence and Encourages Investment in the Future

Protecting IP means securing a portion of a $1.2 trillion industry and the 29 million jobs created directly and indirectly by the mobile connectivity ecosystem. As companies like InterDigital contribute to finalizing the new 5G standard, actions by the Trump Administration to decrease IP theft from China, as well as new policies from the USPTO, are building confidence to encourage investment by U.S. companies that will lead to the development of exciting future technologies. Through smart policy-making and an understanding of the value of these technologies and the standardization process, the U.S. will continue to be a hub for innovation and economy will continue to grow stronger.

The New Era of Antitrust Law and Policy in Standards: Embracing Evidence Based Policy-making

On November 10, 2017, the Department of Justice’s (DOJ’s) new top antitrust enforcer, Assistant Attorney General (AAG) Makan Delrahim, delivered a powerful speech on antitrust law and policy enforcement towards intellectual property rights (IPRs). Former USPTO Director David Kappos described it as “the most important DOJ antitrust speech on IP during my decades practicing law”. … The speech clarifies that the new AAG views “any policy proposals with one-sided focus on hold-up with great skepticism because they pose a serious threat on the innovating process,” and submits that antitrust law should not be misused to police the private commitments such as FRAND that IP holders make to SSOs. In this, the speech agrees with the view shared by several scholars that FRAND commitments are contracts and a potential breach of those commitments may not be best suited under the purview of antitrust law and that “there are perfectly adequate and more appropriate common law and statutory remedies available to the SSO or its members”.

Ericsson publishes FRAND licensing rates for 5G/NR after Qualcomm sued for chip licensing activities

On March 3rd, Swedish telecommunications company Ericsson publicly announced its fair, reasonable and non-discriminatory (FRAND) terms and conditions for the licensing of standard essential patents (SEPs) for 5th Generation New Radio (5G/NR) as standardized by the 3rd Generation Partnership Project (3GPP). The decision to announce these terms publicly may be an indication that Ericsson is looking to avoid the fate of other mobile wireless chip makers, which have come under fire in recent months for their own licensing practices.

White House announces $400 million NSF research initiative for 5G networks

There are challenges that must be overcome through innovation before 5G becomes commercially feasible. Device-to-device communications, which allow mobile device owners to communicate directly without a base station, face challenges of inter-cell interference caused by many small cells operating in an area, as well as difficulties in device discovery. Software defined cellular networks, which are directly programmable without hardware changes, offer simplified network design and dynamic configuration capabilities, but global standards and network infrastructure application are still lacking. To address these and other issues, the White House recently announced a $400 million initiative for advanced wireless research, which will be spearheaded by the National Science Foundation (NSF).

Technology Startups: The Game-changers of Virtual and Augmented Reality

With the advent of enhancements in audio-video technology, Virtual-Reality (VR) has taken the world by storm. While VR has been enjoying most of the limelight, another similar technology – Augmented Reality (AR) is catching up fast. The patent landscape of VR is dominated by Sony followed by IBM, Samsung and Microsoft when it comes to total number of patented inventions. Microsoft is the leader in AR when it comes to the number of inventions filed as patents. It has 602 issued patents and published applications distributed among 151 inventions. Microsoft is followed by Samsung, Sony, LG and Qualcomm.

5G Mobile Networks: The Next Big Battleground

5G is expected to generate even higher revenues from applications and services due to explosion on mobile application and services because of broadband-like speed, which are crucial for some of the emerging technologies like IoT, Wearables and Virtual/Augmented Reality. Revenues for 5G services will exceed $65 billion by 2025, according to a forecast from Juniper Research… The number of patents and key underlying technologies for 5G mobile networks will evolve significantly within next 5 years. However, early analysis shows that Qualcomm will still be the IP leader but may be not as dominant as in 4G-LTE. The device makers like Apple, Samsung, and Lenovo are also working on 5G IP development in order to minimize IP licensing costs.

FCC Chairman Wheeler bullish on broadband future and net neutrality impact

The nature of broadband has been changing in a way that Wheeler believes will spur even more robust data services in the near future. The FCC is taking a number of steps to try and promote competition among broadband service providers, one of the most highly anticipated of which is the incentive auction of broadcast television airwave spectrum which is currently scheduled for the first quarter of 2016. The auction is an attempt to purchase spectrum from TV broadcasters so that it can be resold in a later auction to wireless service providers.
