Realtek Denied Mandamus Relief at CAFC in ITC Battle with AMD

The U.S. Court of Appeals for the Federal Circuit (CAFC) today denied a petition for writ of mandamus filed by Realtek Semiconductor Corporation seeking to direct the International Trade Commission (ITC) to vacate its ruling granting Advanced Micro Devices, Inc. (AMD)’s motion to strike Realtek’s witness from testifying at an upcoming evidentiary hearing.

AMD Win Over TCL and Realtek at ITC Prompts Call for Public Comment

On July 7, 2023, Administrative Law Judge Cameron Elliot issued a Notice of Initial Determination in favor of computer and graphics processor maker AMD. See In the Matter of Certain Graphics Systems, Components Thereof, and Digital Televisions Containing the Same (No. 337-TA-1318). This puts AMD one step closer to preventing TCL and Realtek from importing smart TVs and components containing infringing graphics processors in its patent infringement case at the International Trade Commission (ITC).

AMD scores limited exclusion and cease and desist victory at ITC over VIZIO, SDI and MediaTek

The result of the ITC investigation was a win for AMD with the issuance of a cease and desist order against Respondent VIZIO, a cease and desist order against Respondent SDI, and a limited exclusion order against Respondents VIZIO, SDI and MediaTek. Rather surprisingly AMD has not issued a press release touting the win and is also not otherwise taking a victory lap. Generally, when a company scores a win of this magnitude, with either a limited exclusion order or a cease and desist order, it is news that is shared far and wide. In this case both a limited exclusion order and two cease and desist orders were obtained, and there hasn’t been as much as a peep from AMD. The fact that AMD has chosen to remain silent suggests negotiations are ongoing and an omnibus settlement may be announced in the coming days or weeks.

Nvidia makes interesting moves in low end GPUs for budget gaming

Perhaps the most interesting characteristic of the GeForce GTX 950 is its low price. Nvidia has typically stayed out of the low end budget GPU processing units, content to leave that sector to both AMD and Intel Corporation (NASDAQ:INTC). However, the GeForce GTX 950 retails for $160, representing a serious foray into the low end GPU market which covers most units selling for under $200. It’s not optimal for video games which utilize 4K resolutions but models handling those resolution sizes can cost many hundreds of dollars per unit, made worse by the fact that 1080p is still the pixel resolution standard for video gaming so the extra firepower is largely unnecessary as of yet.

FTC Settles Charges of Anticompetitive Conduct Against Intel

The Federal Trade Commission approved a settlement with Intel Corp. that resolves charges the company illegally stifled competition in the market for computer chips. Intel has agreed to provisions that will open the door to renewed competition and prevent Intel from suppressing competition in the future. Under this agreement Intel must modify its intellectual property agreements with AMD, Nvidia, and Via so that those companies have more freedom to consider mergers or joint ventures with other companies, without the threat of being sued by Intel for patent infringement.
