Open for Business: How Intellectual Property Supports Our Entrepreneurs

Starting a business is steeped with uncertainty, especially during a global pandemic. Small business owners are constantly running through the scenarios: Can I make payroll? Will I recoup my investment? Can I change my community for the better? There are plenty of systems at play that tell them, “No.” It’s too difficult to get a loan; the commercial real estate market is too competitive; advertising and marketing is too expensive. Even so, there’s one system that sings a resounding, “Yes!” That’s America’s intellectual property system.

Dear Candidate: Is patent reform a catalyst for future innovation in the US?

Patent reform is a subject that most Americans are unfamiliar with. Additionally, significant lobbying efforts and financial resources dedicated by large corporations have confused the subject further. Nevertheless, patent reform is a critical issue for our country. Will the U.S. patent system continue to be the fuel that fires genius, to paraphrase President Abraham Lincoln, or will the U.S. patent system continue to throw cold water on the spark of innovative entrepreneurism in America? I’d like to know, and the American public deserves to know, if the candidates are aware of just how cumbersome, one-sided and unfair the U.S. patent system has become.

Recent Patent Related Federal Register Notices

At this time of the year many attorneys and agents are not paying all that much attention to the rules and requests for comments coming out of the Patent Office. Truthfully, with the number of changes that have taken place under the Kappos run Patent Office and the enormity of the America Invents Act many patent attorneys, including myself, are worn out! Add to that the typical end of the year matters for clients and our own businesses and it is easy to miss announcements in November and December.
