House Subcommittees Hold Hearing on Space Situational Awareness and Space Traffic Management

A joint hearing of the House Subcommittee on Strategic Forces and the House Subcommittee on Space was recently convened to discuss the responsibilities of various U.S. government agencies on space situational awareness (SSA) and space traffic management (STM) efforts. The hearing occurred just days after the administration of President Donald J. Trump issued Space Policy Directive-3 (SPD-3) to set a new national space policy to address issues related to both SSA and STM including tracking the existence of space debris, encourage commercial activities in space and improve the national security of the United States in a world where foreign powers are increasing their presence in space.

Texas Representative Lamar Smith to Retire from Congress

Longtime Texas Representative Lamar Smith (R-TX), chairman of the House Committee on Science, Space, & Technology, will be retiring from his duties on Capitol Hill and will not seek reelection for another term of service. Smith, a former Chairman of the House Judiciary Committee and powerful member of the Republican leadership, will leave a void. His retirement marks the end of a 30-year tenure of public service and will immediately create a leadership void on the House committee responsible for overseeing our nation’s science and space policies.

Senate confirms dozens of Trump nominees, including new IP Czar

Vishal Amin was confirmed to be the IP enforcement coordinator at the White House and Peter Davidson was confirmed to be general counsel at the Commerce Department. Amin had been a lawyer for Congressman Lamar Smith (R-TX) working on the AIA and then for Congressman Bob Goodlatte (R-VA) working on the Innovation Act. Therefore, Amin has been in the middle of IP legislation since President Obama took office in January 2009. Before that he worked in the Bush White House and Commerce Department on patent reform and IP issues.  Amin generally favors the Patent Trial and Appeal Board (PTAB) and going after patent trolls.

Change in NASA focus between Administrations may be greatest threat to Mars mission

Multiple members of the hearing’s witness panel attested to the problems created when agency plans change during a change of administration, a problem which Lt. Gen. Thomas P. Stafford, a NASA astronaut during the Gemini and Apollo programs and a member of NASA’s International Space Station Advisory Committee, said has been detrimental to the space program. “We have in recent years seen all too clearly the consequences of a failure to carry out long-term objectives,” Stafford said, referring to NASA’s activities under the Obama Administration as “eight years of lost opportunities… NASA’s present does not do justice to its past.” During questioning, Stafford recommended reestablishing the National Space Council (NSC), which had shown effectiveness in the past in ensuring that multi-year NASA missions which span administrations, such as the Apollo mission to the moon, reach their goal. Stafford also noted that if the federal government had stuck to previous plans to reach Mars, such as were discussed as part of the Space Exploration Initiative carried on under the administration of George H. W. Bush, humans could have reached Mars as early as 2016.

IP and the 115th Congress: Meet the Republicans of the House IP Subcommittee

The House Judiciary Committee will set the agenda for any intellectual property legislative reforms that will arise over the next two years during the 115th Congress, and the Subcommittee on Courts, Intellectual Property, and the Internet will take the lead for the full House Judiciary Committee. Congressman Bob Goodlatte (R-VA) is once again Chair of the House Judiciary Committee, and in that role will continue to have tremendous influence on any intellectual property related matters… At the start of the 114th Congress, Congressman Darrell Issa was made Chair of the Subcommittee on Courts, Intellectual Property, and the Internet. Despite being an inventor himself, the bombastic Issa has aligned himself with Google and other Silicon Valley elites. Issa is not viewed as a friend of independent inventors, and instead lambasts patents trolls as often as he can. While no one likes a patent troll, Issa has taken the unusual step to equate patent trolls with all patent owners who enforce their patents.

Rep. Lamar Smith calls NOAA ‘afraid of innovation’ during hearing on weather satellites

The day’s most withering criticisms, however, came from the House science committee’s ranking Republican, Rep. Lamar Smith (R-TX). Smith contended that NOAA’s problems had been debated by the committee for years and focused on the delays and rising costs of the current JPSS program. “Congress should not continue to fund an over-budgeted program that has not performed to standards,” he said. He added that he wasn’t convinced that the NOAA is adequately addressing weather data gap risks and said they were “dragging their feet” on considering options. “If NOAA’s afraid of innovation, maybe they shouldn’t be in the business of deciding what technologies are needed to improve forecasting,” Smith said.

Whistleblowers testify on on alleged Gurry abuses at WIPO to House Foreign Affairs Committee

The third witness at the House foreign affairs subcommittee hearing was Matthew Parish, legal counsel to WIPO Staff Council. He testified on behalf of WIPO Staff Council members, who are prohibited by the Director General from providing testimony on issues related to whistleblowing or wrongdoing. “It is not an exaggeration to say that members of the Staff Council live in daily fear for their jobs and their careers,” Parish’s statement reads. “WIPO seems to have set a new low when it comes to accountability and management of its affairs.” Parish also spoke to secret raids ordered by Gurry to obtain personal effects from staff members for the collection of DNA as well as Gurry’s actions in dismantling a disciplinary regime in place at WIPO.

A NASA journey to nowhere may be exactly what U.S. needs

It’s unfortunate that NASA has had to operate in such a unfavorable climate, being pushed for more and more answers out of its space exploration program while suffering uncertainty in its federal funding amounts. It would be a mistake for Congress to ground NASA unless fine details on its Mars program are forthcoming. Having a goal oriented target has proven helpful for NASA, but scientific discoveries and the innovations that come therefrom are not easily or even appropriately quantifiable on a spreadsheet, business plan or budget. Historically, NASA space exploration mission objectives have led to great benefits for the American people, even when their plans and mission goals have been a little light on the technical details.

Patent Abuse or Genius? Is Kyle Bass Abusing the Patent System?

Time and time again throughout the legislative history post grant proceedings were explained as being a faster, low-cost alternative to litigating validity disputes in Federal District Court. That being the case, it would seem extremely odd that any petitioner could bring a post grant challenge to a patent when that petitioner would not have standing to sue to invalidate the patent in Federal District Court. However, the statute does say that a person other than the patent owner can file a petition to institute an inter partes review.

IP and the 113th Congress: The Republicans of the House Subcommittee on Intellectual Property

Earlier this week House Judiciary Committee Chairman Bob Goodlatte (R-VA) announced the House Judiciary Committee’s Republican subcommittee assignments for the 113th Congress. The subcommittee from the House of Representatives that has jurisdiction over matters relating to intellectual property is the Subcommittee on Intellectual Property, Competition, and the Internet. This subcommittee has jurisdiction over copyright, patent, trademark law, information technology, antitrust matters, as well as other appropriate matters as referred by the Chairman. It is this House Subcommittee on IP that will be one of the primary focal points for any new legislation that deals with intellectual property over the next two years.

Patent Law Changes – Claims Unnecessary to Obtain a Filing Date

On Wednesday, December 5, 2012, the House of Representatives passed two bills that are now await President Obama’s signature. The bill — S. 3486— implements both the Patent Law Treaty (PLT) and the Hague Agreement Concerning the International Registration of Industrial Designs. The U.S. Senate previously passed the same bill in the same form on September 22, 2012. Thus, the remaking of U.S. patent law and patent practice continues, and we will see more rulemaking coming from the United States Patent and Trademark Office.

Prior User Rights and the Incentive to Keep Innovations Secret

However, if prior users are keeping their technology secret while being protected, that leap-frogging from one breakthrough to the next be impeded. Disclosure is the backbone of the progression of the sciences for this reason. “[T]he ultimate goal of the patent system is to bring new designs and technologies into the public domain through disclosure.” Bonito Boats v. Thunder Craft Boats, 489 U.S. 141, 151 (1989). Sharing ideas allows others to improve upon the state of the art and as a result, better products such as medicine and consumer electronics are brought to market thereby driving our economy and benefiting the welfare of the U.S. as a whole. Prior user rights, on the other hand, will inhibit this progression.

Prior Art Under America Invents: The USPTO Explains First to File

If (B) gives a blanket exclusion to subject matter, which cannot be used as prior art after a disclosure by an inventor, that would lead to nearly ridiculous results. Imagine for example that an inventor discloses a specific embodiment of a coffee cup and then subsequently another who did not derive independently comes up with and discloses a coffee cup with a lid. If (B) does more than relate to a personal grace-period the subsequent disclosure could not be used against the first to publish inventor as prior art because it relates to the same “subject matter.” That would mean that the inventor could incorporate the cup and the lid into his/her patent application and obtain claims. You might be tempted to say that is impossible, but if the cup with the lid is not prior art then under what rationale could an examiner issue a good rejection? This would lead to results that turn the patent system upside down, and was clear evidence to me that those arguing that 102(b)(1)(B) excluded out subsequent independently disclosed inventions was fanciful at best.

Reshaping U.S. Patent Law. Who are the Winners & Losers?

It is fair to say that enactment of the AIA is not what most stakeholders championed early on. Many small inventors and innovation companies feel that some of the provisions are not in their best interest. IT would have preferred a bill that did more to change how patents are valued and enforced. Nevertheless, to most stakeholder, the final version of the bill is an improvement over previous versions of patent legislation. When patent reform legislation was first introduced in 2005, its primary objective was to reduce the infringement liability of large technology aggregators by significantly limiting equitable and monetary remedies, restrict venue, and make issued patents far easier to invalidate through post-grant review. In addition, earlier versions of the bill would have given the USPTO unprecedented substantive rulemaking authority and increased the cost and burden of filing a patent application. In combination, these measures would have significantly undermined the enforceability and value of patent rights, while increasing the cost, complexity, and uncertainty of obtaining patents. All of these reforms were advanced by a IT interests set on weakening the ability of small innovators to obtain and enforce patents.

The America Invents Act – How it All Went Down

On Friday, September 16, 2011, President Obama signed into law “The America Invents Act” (“AIA”) which passed the Senate on September 8, 2011, by a vote of 89-9. The AIA passed the House of Representatives on June 23rd by a vote of 304-117. The measure, which is the product of a seven-years-long legislative battle among patent policy stakeholders, changes how patents are obtained and enforced in the United States. Important reforms to patent law are incorporated into the AIA and, just as significantly, several controversial proposed changes were deleted from the AIA before final passage. This article is a play-by-play of the process and how it unfolded.
