House Small Business Committee Holds Hearing on IP in Digital Economy With a Mostly Anti-Patent Panel

On the morning of Wednesday, July 11th, the House Small Business Committee held a hearing titled Innovation Nation: How Small Businesses in the Digital Technology Industry Use Intellectual Property. Though the witness panel was not quite as one-sided as those seen testifying in front of the House IP Subcommittee in recent years, an informed observer could not help but conclude that yet another opportunity to seriously address the damaged state of the U.S. patent system was missed to the detriment of many of the small businesses which the committee purports to protect.

European Commission Unveils Digital Tax Proposal Which Could Generate Billions in Tax Revenues from American Tech Giants

The European Commission has recently proposed new tax rules that would significantly alter the tax regime faced by technology companies operating in the European Union, including American tech giants like Google and Facebook. The proposal from European authorities would tax tech company revenues in the country where those revenues are generated rather than where the companies are regionally located; supporters of the proposal note that this would keep tech companies from reducing tax payments by locating regional headquarters in European nations with lower tax levels.

Achieving a balanced IP system to ensure content creators can keep creating in the digital age

I think the long-term benefits to authors are greater than the downsides or the risks. But, like any time there’s a shakeup of an industry, there are short-term and long-term winners and losers. I’ll even use the term “digital disruption,” although it is way overused these days (and too often used as a poor excuse for infringing copyright). Digital technology is disrupting the industry as a whole. We had the same business models for the better part of at least a century, and while things are starting to change, we’re still largely operating as we did in the past, based on old business models with just a few tweaks. We haven’t fully evolved yet, and as a result we’re mostly seeing a little bit of the downside. Whenever there’s a disruption in business models, someone is negatively affected. Unfortunately, here it is the authors, and creators generally. And that’s because creators in these industries tend to have the least bargaining power and they tend to be a line item in a budget where there is some discretion.

Digital publishing sector increases share of magazine readership, advertising dollars

Between August 2012 and February 2013, digital publishing apps saw an average growth in their readership of 200 percent according to a state of mobile tech report released by computer software company Adobe Systems. Online statistics portal Statista report statistics showing that 88 percent of North American newspapers were distributing content on mobile devices by 2010. It’s not just readers that are heading to the digital realm, but advertising dollars are also helping to buoy the nascent digital magazine sector. Forecasts reported by professional services network PricewaterhouseCoopers (PwC) indicate that digital advertising expenditures should rise from $2.4 billion in 2012 up to $3.8 billion in 2017, when they will account for one-quarter of all advertising spending.

Fair Use in the Digital Age: Reflections on the Fair Use Doctrine in Copyright Law

Judge Leval found fair use and ruled in favor of the defendants. However, this was quickly reversed and remanded by the Second Circuit Court of Appeals under the logic that that previously unpublished works were immune from fair use due to a right of privacy. Leval now thinks his opinion deserved to be reversed, but the Court of Appeal’s opinion was even more problematic. He opined that the “[i]nability to quote from unpublished documents would seriously impair history, political commentary, [and] journalism.” As he described Craft v. Kobler (1987), New Era Publications v. Henry Holt & Co. (1988), and American Geophysical Union v. Texaco (1992), a pattern became clear: Judge Leval’s application of the fair use doctrine throughout the past thirty years has been based on furthering the advancement and edification of the public.

Internet Policy Task Force to Host Series of Roundtables on Copyright Internet Policy Topics

The purpose of the roundtables is to engage further with members of the public on the following issues: (1) the legal framework for the creation of remixes; (2) the relevance and scope of the first sale doctrine in the digital environment; and (3) the appropriate calibration of statutory damages in the contexts of individual file sharers and of secondary liability for large-scale infringement. The roundtables, which will be led by USPTO and the National Telecommunications and Information Administration (NTIA), will be held in Nashville, TN on May 21, 2014, Cambridge, MA on June 25, 2014, Los Angeles, CA on July 29, 2014, and Berkeley, CA on July 30, 2014. The meetings were called for in the Task Force’s Green Paper on Copyright Policy, Creativity, and Innovation in the Digital Economy released last year.

Department of Commerce to Host Meeting & Seek Comments on “Copyright Policy, Creativity, and Innovation in the Digital Economy”

The meeting will be held on October 30, 2013, in Washington, D.C. The IPTF intends to hold the public meeting in the Amphitheatre of the Ronald Reagan Building and International Trade Center, 1300 Pennsylvania Avenue, N.W., Washington, D.C. The Green Paper, the IPTF proposes five copyright policy issues to address, and the meeting will provide an opportunity for discussion that will be used to formulate the IPTF’s views and recommendations regarding copyright policy. The five issues include: (1) establishing a multistakeholder dialogue on improving the operation of the notice and takedown system for removing infringing content from the Internet under the Digital Millennium Copyright Act (DMCA); (2) the legal framework for the creation of remixes; (3) the relevance and scope of the first sale doctrine in the digital environment; (4) the application of statutory damages in the contexts of individual file sharers and of secondary liability for large-scale infringement; and (5) the appropriate role for the government, if any, to help improve the online licensing environment, including access to comprehensive databases of rights information.
