Patent Integrity: An Appeal to College Presidents

A clique of multinational corporations is pushing legislation that will be a disaster for the rest of us, especially our universities with research components. Small inventors and their patrons in academia are being asked to swallow large dosages of poison encapsulated in the bill. Two features are especially concerning: mandatory fee shifting and involuntary joinder. Together and separately, they seriously weaken and put at risk the university technology transfer process, so necessary to America’s innovative and entrepreneurial way of life.

Patent Reform 2.0 – The Next Round of Patent Reform

On Monday, May 11, 2015, IPWatchdog will a co-sponsor a roundtable discussion on patent reform. This event will take place at the law offices of McDermott Will & Emery, which is located directly across the street from the U.S. Capitol. Bernie Knight, a partner with McDermott and a former General Counsel to the United States Patent and Trademark Office, will co-moderate the event along with me. House Judiciary Committee Questions PTO Director Lee on Innovation Act

There were statements recognizing the need to keep open legitimate avenues to for innovators to protect themselves against infringement, and a strong desire to make sure that legislation focus on bad actions and actors. Not surprisingly, the Committee seems to largely think that the Innovation Act does strike the proper balance, although there was also recognition that changes could be made to make the bill better. USPTO Director Michelle Lee was wholeheartedly in support of fee shifting, justifying the position by saying that fault based fee-shifting will raise the costs for those who engage in abusive actions.

Patent reform on the agenda when Congress returns this week

Patent reform is back on the agenda when Congress returns from recess this week. On Tuesday, April 14, 2015, at 2:00 pm ET, the House Judiciary Committee will hold a hearing on H.R. 9, more commonly referred to as the Innovation Act. Then on Thursday, April 16, 2015, at 11:00 am ET, the Commerce, Manufacturing and Trade (CMT) Subcommittee of the House Energy & Commerce Committee will also hold a patent related hearing. The subject of the CMT hearing will be the Targeting Rogue and Opaque Letters Act (TROL Act).

Inventors go to Washington Giving Perspective on the Innovation Act

Incredibly, despite widespread damage to inventors, most staffers still do not understand how the patent system works to create innovation, jobs, and economic growth. They do not understand how patents drive capital to small patent-based businesses thus delivering the vast majority of our new technologies to American consumers. How can it be that they have not heard this perspective? Why aren’t the patent lobbyists in Washington like IPO and AIPLA protecting the patent system? Are the views of inventors so far apart from corporate patent owners? Or are the companies so caught up in other Washington issues that pushing hard for strong patent rights conflicts with other agendas and political asks? Too many Congressional staffers don’t understand the patent system, but staffers are not the ones at fault here.

The Innovation Act vs. The Innovation System

There is no credible evidence behind proposals to make the drastic changes embodied in the Innovation Act, the removal of discretion from judges to judge each case on an individual basis with mandatory stays and fee shifting, and new rules for pleading and discovery that would undermine the ability of legitimate inventors and patent holders from enforcing their rights against infringers.

Issa strikes defiant tone over patent reform

Congressman Darrell Issa (R-CA), a member of the House Judiciary Committee and the Chair of the Subcommittee on Courts, Intellectual Property, and the Internet, struck a defiant tone this morning speaking at the National Press Club. Issa explained in no uncertain terms that the patent litigation reforms contained within the Innovation Act will not be watered down, period. He told the audience that never again will a defendant first learn of the allegations against them only at the end of the case.

Patent Reform to be introduced in House next week

Multiple sources have confirmed that House Judiciary Committee Chairman, Congressman Bob Goodlatte (R-VA), will soon introduce the latest round of patent reform legislation in the United States House of Representatives. The bill, which will be nearly identical to the Innovation Act, which Goodlatte introduced during the 113th Congress, is expected to be introduced on Thursday, February 5, 2015. Goodlatte will bypass the Subcommittee on Courts, Intellectual Property, and the Internet, and the bill will proceed directly to the Committee level.

IP and the 114th Congress: Meet the Republicans of the House IP Subcommittee

With respect to intellectual property it is the House Judiciary Committee that will set the agenda for any potential legislative reform over the next two years, with the Subcommittee on Courts, Intellectual Property, and the Internet leading the way. The often controversial Darrell Issa has lost his leadership position on the House Oversight Committee, but he has gained the gavel of this IP subcommittee. Few anticipate that he will easily be relegated to the back bench, so look for an active and bumpy ride over the next two years.

Congressional Testimony: Lee on USPTO Patent Operations

Lee will tell Congress that the USPTO is on pace during FY 2014 to receive nearly 600,000 patent applications, which represents an increase of more than 5% as compared to FY 2013. The PTO backlog of unexamined patent applications is less than 620,000 which is down from more than 750,000 in 2009 (a 17.3 percent decrease)… On a cynical note, I will observe that reducing the backlog will become much easier for the USPTO, as will meeting pendency goals, based upon the United States Supreme Court’s breathtaking decision in Alice v. CLS Bank. While not a subject of this hearing, as more and more becomes per se unpatentable as the result of 35 U.S.C. 101, the USPTO should easily be able to meet these goals, particularly in light of the reality that over 50% of patents issued by the USPTO related to software innovations.

Prominent Independent Inventors Unhappy with Innovation Act

“Notably, the concerns of key inventor stakeholders like us – principally small companies that create the fundamental inventions that drive our innovation economy – have not yet been evaluated in depth. Historically, the vast majority of legitimate patent holders have honorably sought the fruits of their labor through patent rights promoted by the Constitution and secured by Congress, by licensing when possible and litigating when necessary. Our nation and, indeed, our planet have benefitted enormously as a result of the identification and disclosure of these discoveries through the U.S. patent system. Legitimate inventors and patent holders should not be confused with, or punished as a result of, a small minority of bad actors who create shell entities that send mass demand letters for the purpose of seeking money under the threat of unjustifiable litigation.”

Patent Reform: House Holds Hearing on “Innovation Act”

The hearing focused on the effect the Innovation Act would have on the problem of abusive litigation practices and on the patent system as a whole. Three central themes emerged from the hearing: 1) there is an urgent need to fully fund the PTO; 2) significant skepticism remains about expansion of the Covered Business Method (“CBM”) program; and 3) some of the more technical aspects of the Innovation Act would help rid the patent system of expensive and wasteful lawsuits. Divergence of opinion remained among the Members, however, about whether Congress should address fee shifting at this time or wait for the Supreme Court to hear the two fee shifting cases before it, although the witnesses agreed that legislation on fee shifting would be helpful, and Congress should proceed with legislation on this front.

Will Congress Succumb to the Sirens’ Song and Take-Over the Judiciary’s Case Management Role in Patent Litigation?

A troubling fundamental aspect of the proposed mandatory stay is that it would chip away at the quid pro quo of the patent bargain. To ensure the Constitutionally-protected exclusive right, patent rights have long been recognized as covering multiple and independent separate causes of action: “whoever without authority makes, uses, offers to sell, or sells any patented invention, within the United States or imports into the United States any patented invention during the term of the patent therefor, infringes the patent.” 35 U.S.C. § 271(a) (emphasis added). Strict liability attaches to each one of these forms of infringement independently of the others. These are separate violations, any one of which being subject to injunctive relief “to prevent the violation of any right secured by patent.” 35 U.S.C. § 283.

House Subcommittee Pursues Answers to Litigation Abuses by Patent Assertion Entities

The House Judiciary Subcommittee on Courts, Intellectual Property, and the Internet on March 14, 2013, heard from six witnesses that the business of “patent assertion entities” (PAEs) is inflicting severe harm on a broad range of technology users. The witnesses at the hearing agreed that, when confronted PAE demand letters on frivolous claims, settlements by and large are economically unavoidable.

The 113th Congress: Meet the Democrats on the House Subcommittee on Intellectual Property

Two weeks ago House Judiciary Committee Chairman Bob Goodlatte (VA-6) announced the House Judiciary Committee’s Republican subcommittee assignments for the 113th Congress. See Republicans of the House Subcommittee on Intellectual Property. Today we meet the Democrats on the Subcommittee. It is the Subcommittee on Intellectual Property, Competition, and the Internet that has primary jurisdiction over matters relating to intellectual property matters. Thus, the House Subcommittee on IP that will be one of the primary focal points for any new legislation that deals with intellectual property over the next two years.
