Mandamus and the Battle Over Venue in Modern America

The United States Court of Appeals for the Federal Circuit (CAFC) has become enamored with the power of the writ of mandamus to correct what they do not like, and they do not like patent owners filing patent infringement actions in Texas. Or, perhaps it is more accurate to say that while they might not mind patent owners filing patent infringement actions in Texas, they expect federal district court judges in Texas to order those patent owners off to other courthouses outside of Texas upon the request of defendants.

Western District of Texas Gets an Upgrade: A Look at the New Waco Courtroom

Anyone who is familiar with the fortunes of Waco, Texas over the past few years will recognize the remarkable transformation of the city in most every respect. This is often attributed to Chip and Joanna Gaines of HGTV’s “Fixer-Upper” fame. The legal world has its own version of a “fixer-upper” success story in Waco, and it has nothing to do with any renovation television series. With the arrival of Judge Alan D. Albright a little over two years ago, the Waco division of the Western District of Texas began its own transformation in every respect.

Federal Circuit Grants Apple Petition for Writ of Mandamus to Transfer Uniloc Suit

On November 9, the Federal Circuit granted Apple’s petition for a writ of mandamus directing the Western District of Texas to transfer Uniloc’s patent infringement suit against Apple to the Northern District of California. Judge Moore dissented, asserting that the majority applied an incorrect standard of review.
