The App Developers Alliance is joining with law schools nationwide to help startups battle patent trolls. The Law School Patent Troll Defense Network is a consortium of law school clinics that will provide free legal representation to small app developers and other entrepreneurs that have been threatened or sued by patent trolls. Clinics participating in the Network may also represent the Alliance in major patent cases affecting developers and the app community.

If you have not tried to use the After Final Pilot you should really give it a try. At our firm we have found examiners quite willing to work with us After Final under the Pilot Program and have had successful results. While not appropriate to do everything you really may want to do After Final, many times you can make at least some substantive changes that would have normally required the filing of an RCE or Continuation. I personally think the Pilot has already proven to be a success and hope that the USPTO will continue to extend the deadline until this can ultimately be made permanent.

Alissa J. Holterman is the Assistant Director of Career Services at Loyola University Chicago School of Law, has been the primary administrator of for the last 5 years. Holterman says there are objective signs of improvement in the patent job market for new and recent law school graduates, and real reason for optimism. “This year there will be 123 employers are coming to PLIP, and they’ve asked for a total of 232 day-long interview schedules. That’s almost a 20% increase in employers since last year, and more than a 20% increase in interviews, ” says Holterman. “That’s more employers and interviews than any year since 2008.”

The United States Patent and Trademark Office (USPTO) today announced that it will open the current Patent Law School Clinic Certification Pilot Program to admit 10 additional schools for the upcoming fall 2012 academic year. This pilot program allows law students to practice patent law before the agency under the guidance of a law school faculty clinic supervisor. Submissions from interested law schools will be accepted through Friday, June 1, 2012.

Many readers of IPWatchdog.com know that I hold two degrees from the former FPLC, both my Juris Doctor and my Master of Laws in intellectual property, and continue to have a special place in my heart for the institution and the people affiliated with the institution. It is good to see that the UNH School of Law continues the tradition of Franklin Pierce Law Center. UNH-FPLC has been ranked each and every year since U.S. News began their specialty law school rankings began in 1992.

On the other hand, my presentation to the law students at Duquesne and Pitt were remarkably predictable. Whenever I travel to speak at law schools I inevitably get asked questions about what students should be doing to (1) set themselves up in a position to be hired; and (2) how to ultimately land a job. primarily about how to go about finding a job in this, or any other economy. With that in mind I thought it might make sense to do a primer on steps that can be taken in order to find a legal job.

If you look at the list, when they first started doing these ranking we were number one, then we were number four, and then we dropped. Now we’re number nine, and they only rank through number ten. So we’re tied for ninth with Duke, which is amazing given our size and our location. Now, the schools ahead of us are Michigan, Harvard and Stanford. In many ways we would never be on that list. To remain on the list, we needed to be in a bigger boat. We needed more resources. Otherwise, we might be pushed off the list, and we don’t want to fall off that list. So I think in some ways we were entrepreneurial as the school has always been, in ensuring our long term vitality. I think our capacity to be a larger player potentially with more resources, with more interdisciplinary activity in our IP center, has been enhanced.

On January 28, 2011, the recently retired Chief Justice of the New Hampshire Supreme Court, John Broderick, became the Dean and President of the University of New Hampshire School of Law. The new UNH School of Law is the law school formerly known as Franklin Pierce Law Center, renowned around the world for its intellectual property program. On January 31, 2011, I had the opportunity to chat with Chief Justice Broderick, who prefers to go by his first name these days.

While the market is recovering, I suggest finding something to keep your spirits up, and I do believe that it’s different for everyone, depending on personality. My advice to individuals seeking employment in this market, particularly this legal market, is to do good works that make you feel successful in at least one facet of your life. Take this time to focus on small things and improve yourself. Work on maintaining relationships with your friends and family. Work on your marriage. Reduce clutter in your home or apartment. Become more health conscious and physically fit. Learn a new skill. Find a way to excel in whatever professional capacity you are currently serving in. See the positive, navigate around the negative, and carry a pleasant expression on your face; no one wants to hire or be around a sourpuss. Howl to some Warren Zevon and watch some funny YouTube videos. Hold a puppy. Things will get better.

I have been asked to create a patent curriculum that will have at a minimum 24 credit hours of patent related legal education, perhaps more.  As you might expect, I have some ideas about how to fill the curriculum, but thought I might open this up for discussion here to gain the collective thoughts, wisdom and insights of IPWatchdog.com readers.…
