Silent Summer: What COVID-19 Means for the Class of 2020

Law firms are not at all immune to this pandemic since their clients aren’t.  Most law firms have cut partner pay, and cut the pay of associates also.  They are also firing and furloughing partners and associates.  We all know that most of Society cares not that lawyers suffer, economically that is.  But there is a class of lawyers, actually lawyers-to-be, that we should have sympathy and empathy for: incoming first year associates.  The Class of 2020 will have a very tough time, even tougher than the Classes of the last downturn in 2008 and 2009.  The associates that suffered then are likely partners now, and have more empathy.

University of New Hampshire Franklin Pierce Launches Innovative Hybrid JD Program

In the digital age, it’s curious that so many online educational opportunities exist, yet very few provide a legal education. To meet this growing need, The University of New Hampshire Franklin Pierce School of Law just launched its Hybrid JD Program for professionals interested in intellectual property, technology, and information law. “Some IP professionals who are working full-time are not in a position to quit their existing jobs and move to New Hampshire, but I believe that they should still have access to a top-ranked program in IP,” said Megan Carpenter, Dean of UNH Franklin Pierce School of Law. “Through this program, we are making a legal education in IP accessible to those who would not otherwise be able to get it…. This program is the first hybrid JD approved by the ABA in a specialized area of law, [and] the entire program is carefully curated to train the IP leaders of tomorrow.”

Don Dunner Named Chair of John Marshall’s IP Center Advisory Board

Mr. Donald Dunner, a partner in Finnegan, Henderson, Farabow, Garrett & Dunner, LLP in Washington, D.C. has accepted JMLS’ offer to chair the Advisory Board of the School’s Center for Intellectual Property, Information and Privacy Law. In accepting the position of Chair of the Advisory Board Dunner stated, “John Marshall is one of the preeminent centers of legal education in the IP field. I look forward to assisting it in that role.”

Shontavia Johnson Named Director of Drake Intellectual Property Law Center

Shontavia Johnson, professor of law and the Kern Family Chair in Intellectual Property Law, took over as director of Drake Law School’s Intellectual Property Law Center on July 1.

Law Schools Join App Developers Alliance to Fight Patent Trolls

The App Developers Alliance is joining with law schools nationwide to help startups battle patent trolls. The Law School Patent Troll Defense Network is a consortium of law school clinics that will provide free legal representation to small app developers and other entrepreneurs that have been threatened or sued by patent trolls. Clinics participating in the Network may also represent the Alliance in major patent cases affecting developers and the app community.

USPTO Extends After Final Pilot; USPTO Adds Advancement of Examination Option to Law School Clinic Program

If you have not tried to use the After Final Pilot you should really give it a try. At our firm we have found examiners quite willing to work with us After Final under the Pilot Program and have had successful results. While not appropriate to do everything you really may want to do After Final, many times you can make at least some substantive changes that would have normally required the filing of an RCE or Continuation. I personally think the Pilot has already proven to be a success and hope that the USPTO will continue to extend the deadline until this can ultimately be made permanent.

Legal Jobs: Patent Job Market Shows Signs of Improvement

Alissa J. Holterman is the Assistant Director of Career Services at Loyola University Chicago School of Law, has been the primary administrator of for the last 5 years. Holterman says there are objective signs of improvement in the patent job market for new and recent law school graduates, and real reason for optimism. “This year there will be 123 employers are coming to PLIP, and they’ve asked for a total of 232 day-long interview schedules. That’s almost a 20% increase in employers since last year, and more than a 20% increase in interviews, ” says Holterman. “That’s more employers and interviews than any year since 2008.”

PTO Expands Patent Law School Clinic Certification Pilot Program

The United States Patent and Trademark Office (USPTO) today announced that it will open the current Patent Law School Clinic Certification Pilot Program to admit 10 additional schools for the upcoming fall 2012 academic year. This pilot program allows law students to practice patent law before the agency under the guidance of a law school faculty clinic supervisor. Submissions from interested law schools will be accepted through Friday, June 1, 2012.

UNH Law Once Again in Top 10 IP Law Schools

Many readers of IPWatchdog.com know that I hold two degrees from the former FPLC, both my Juris Doctor and my Master of Laws in intellectual property, and continue to have a special place in my heart for the institution and the people affiliated with the institution. It is good to see that the UNH School of Law continues the tradition of Franklin Pierce Law Center. On the other hand, my presentation to the law students at Duquesne and Pitt were remarkably predictable. Whenever I travel to speak at law schools I inevitably get asked questions about what students should be doing to (1) set themselves up in a position to be hired; and (2) how to ultimately land a job. primarily about how to go about finding a job in this, or any other economy. With that in mind I thought it might make sense to do a primer on steps that can be taken in order to find a legal job.

If you look at the list, when they first started doing these ranking we were number one, then we were number four, and then we dropped. Now we’re number nine, and they only rank through number ten. So we’re tied for ninth with Duke, which is amazing given our size and our location. Now, the schools ahead of us are Michigan, Harvard and Stanford. In many ways we would never be on that list. To remain on the list, we needed to be in a bigger boat. We needed more resources. Otherwise, we might be pushed off the list, and we don’t want to fall off that list. So I think in some ways we were entrepreneurial as the school has always been, in ensuring our long term vitality. I think our capacity to be a larger player potentially with more resources, with more interdisciplinary activity in our IP center, has been enhanced.

The Struggle of Law School Graduates in a Difficult Job Market

While the market is recovering, I suggest finding something to keep your spirits up, and I do believe that it’s different for everyone, depending on personality. My advice to individuals seeking employment in this market, particularly this legal market, is to do good works that make you feel successful in at least one facet of your life. Take this time to focus on small things and improve yourself. Work on maintaining relationships with your friends and family. Work on your marriage. Reduce clutter in your home or apartment. Become more health conscious and physically fit. Learn a new skill. Find a way to excel in whatever professional capacity you are currently serving in. See the positive, navigate around the negative, and carry a pleasant expression on your face; no one wants to hire or be around a sourpuss. Howl to some Warren Zevon and watch some funny YouTube videos. Hold a puppy. Things will get better.

What Skills Should New Patent Associates Have?
