On April 21, 2022, LG Electronics Inc. filed suit against Chinese television manufacturer, TCL, through several of its affiliates and related entities, in the Eastern District of Texas for patent infringement. See LG Electronics, Inc. v. TCL Electronics Holding Ltd. et al, Case: 2:22-cv-00122 (EDTX). The patents relate to display hardware, wireless transmission technology, and user interface controls. Several of TCL’s 4-Series, 5-Series, and 6-Series TVs are accused of infringement. The patents asserted by LG are U.S. Patent Nos. 7,982,803, 9,080,740, 9,788,346, 10,334,311 and 10,499,431. LG requests a jury trial, seeks a permanent injunction, and a finding that the infringement is willful (for enhancement purposes) and exceptional (for the awarding of attorneys’ fees).

The U.S. Court of Appeals for the Federal Circuit (CAFC) in In re Samsung today granted Samsung’s and LG’s writs of mandamus, which sought to order the United States District Court for the Western District of Texas to transfer the underlying actions to the United States District Court for the Northern District of California. The CAFC explained that the district court erred in failing to consider pre-litigation tactics by Ikorongo Technology LLC (Ikorongo Tech) and Ikorongo Texas LLC aimed at purposely manipulating venue in the case.

Samsung Display and LG Display, the two South Korean technology behemoths, announced plans earlier this year to stop the production of LCDs by the end of 2020. The announcements first appeared in Reuters’ reports and aim to consolidate the two companies’ lead in organic light emitting diode (OLED) panels, while conceding to Chinese manufacturers who have aggressively expanded their LCD productions. LCD prices have slumped over the years, as Chinese manufacturers backed by state subsidies have aggressively expanded production capacities. The plunging LCD prices have widened the operating losses at both Samsung and LG Display and finally led to the decision to cut production by year’s end.

Yesterday, the U.S. Court of Appeals for the Federal Circuit, in an opinion authored by Judge Moore, reversed and remanded a decision of the U.S. District Court for the Northern District of California, which had found that certain claims of Uniloc’s U.S. Patent No. 6,993,049 were ineligible under Section 101 as being directed to an abstract idea. The Federal Circuit disagreed, holding that the claims at issue were directed to a “patent-eligible improvement to computer functionality.”

There were 174,317 patent applications filed at the European Patent Office in 2018, according to figures in its Annual Report published today (March 12). That represents an increase of 4.6% on 2017, when there were 166,594 applications. The number of patents granted also increased. The EPO published 127,625 granted patents in 2018, up 21% on 2017. U.S. entities are once again the most prominent applicants at the EPO, accounting for 25% of all applications in 2018. The U.S. is followed by Germany (15%), Japan (13%), France (6%) and China (5%). Applications from Germany grew by 4.7%, which the EPO attributed to an upward trend in the automotive sector and related areas, such as sensors and other measuring devices.

The Alliance of U.S. Startups and Inventors for Jobs (USIJ) recently released a report detailing the organization’s research into serial attacks on high quality patents at the Patent Trial and Appeal Board (PTAB). The USIJ’s research shows that, far from being a cheaper alternative venue for small businesses to challenge the validity of weak patents being asserted against them as was originally intended, the administrative tribunal has instead become a tool for rich, sophisticated companies who are able to harass owners of valuable patents with duplicative petitions filed either by themselves or by profiteering entities which weren’t envisioned when the Leahy-Smith America Invents Act (AIA) of 2011 was passed into law.

Why is it that innovators such as Universities and independent inventors are caricatured as patent trolls while entities such as Unified Patents and RPX, who exist for the sole purpose of destroying property, are somehow let off the hook or even celebrated? In a different era, about 100 years ago, those large corporations and their allies who ganged up on smaller companies and individuals were characterized as ‘robber barons’ and caricatured as ‘fat cats’… The AIA makes clear that patent owners should not have to endure repeated attacks on their patent claims at the PTAB.

The latest television technology (4K) contains four times the number of pixels as 1080p (full HD). Without HEVC, broadcasters wanting to transmit programs in 4K quality face the challenge of needing high quality broadband reception to make 4K broadcasts a reality. A benefit of HEVC is that it makes broadcasting 4K more feasible – reducing both the cost and time it takes to deliver high quality programming. While the technology is anticipated to be used in almost all video processors and display devices in the future, adoption remains slow because of a complex licensing scenario.

The date of patent number 10,000,000 will be June 19, 2018. We feel this one is the easiest part of the prediction. We also think the USPTO will award Patent 10,000,000 to Application 13/666670 – SEARCH SPACE DESIGN FOR E-PDCCH IN WIRELESS COMMUNICATION NETWORKS from Qualcomm Inc.

The Federal Circuit affirmed the district court’s denial of LG‘s motion for summary judgment that various claims of Core’s patents were directed to patent ineligible subject matter under Section 101. The Court also affirmed the district court’s denial of LG’s motions for judgment as a matter of law that the claims were anticipated and not infringed… The concept of summarizing information can be patent eligible (not abstract) when specifically applied to improving the efficiency of the electronic device, as in a “particular manner of summarizing and presenting information in electronic devices.”

Broadcom Ltd. filed a series of six lawsuits in the U.S. District Court for the Central District of California alleging the infringement of a series of patents covering semiconductor technologies. The patent lawsuits target firms making and selling consumer audiovisual products or other articles which utilize system on a chip (SoC) semiconductors and similar processing equipment… Although most of the Broadcom suits assert multiple patents, there is only one patent asserted in each case: U.S. Patent No. 7,310,104, titled Graphics Display System with Anti-Flutter Filtering and Vertical Scaling Feature.

On Wednesday, January 18th, the U.S. International Trade Commission (ITC) began a probe into a Section 337 patent infringement complaint involving graphics processors and memory controllers against a collection of 17 firms, according to Reuters. These firms include some tech giants in the world of semiconductors and electronics, including Qualcomm, Inc. (NASDAQ:QCOM), Sony Corp. (NYSE:SNE), LG Electronics (KRX:066570), Lenovo Group (HKG:0992), Motorola Mobility LLC and Advanced Micro Devices, Inc. (NASDAQ:AMD) The Section 337 complaint was filed on December 16th by ZiiLabs Ltd., a Bermuda subsidiary of Hong Kong’s Creative Technology Asia Limited.

With the advent of enhancements in audio-video technology, Virtual-Reality (VR) has taken the world by storm. While VR has been enjoying most of the limelight, another similar technology – Augmented Reality (AR) is catching up fast. The patent landscape of VR is dominated by Sony followed by IBM, Samsung and Microsoft when it comes to total number of patented inventions. Microsoft is the leader in AR when it comes to the number of inventions filed as patents. It has 602 issued patents and published applications distributed among 151 inventions. Microsoft is followed by Samsung, Sony, LG and Qualcomm.
