New Balance wins largest verdict ever for foreign plaintiff in Chinese trademark suit

This latest victory for a foreign plaintiff asserting intellectual property claims is proof of yet another step down the road leading to a reformed, intellectual property friendly China, with China cracking down on infringers — as promised by Chinese President Xi Jinping… The Chinese IP court in Beijing reportedly ordered three domestic shoemakers to pay a total of 10 million yuan ($1.5 million USD) to New Balance for infringing upon the slanted ‘N’ logo utilized by New Balance on its branded shoes. That’s not a huge damages award in the grand scheme of trademark damages ordered around the world but reports indicate that the damages in this cases were the most ever handed out by a Chinese court to a foreign plaintiff for trademark infringement allegations.

Sportbrain files smartwatch fitness tracker patent suits against Apple, HP, Michael Kors and New Balance

At the center of each lawsuit is the assertion of a single patent covering personal data collection technology integrated into a series of smartwatches. The patent-in-suit asserted by Sportsbrain against each of these defendants is U.S. Patent No. 7,454,002, titled Integrating Personal Data Capturing Functionality into a Portable Computing Device and a Wireless Communication Device and issued to Sportbrain in November 2008… Each of the suits filed by Sportsbrain identifies a specific product and companion apps which work in tandem to collect personal data and provide feedback to wearers.

Nike Converse’s ITC strategy a mixed bag

In late 2014, Nike Converse Inc. launched an aggressive attack in the U.S. District Court in Brooklyn against companies including Walmart, Under Armour and Ralph Lauren for infringing upon Converse’s signature Chuck Taylor shoe. Nike Converse sued a total of 31 companies for copying the rubber “bumper” running around the front, a “toe cap” on the top of the shoe above the bumper, and lines or stripes running around the sides of the classic kick. Many of us have either owned or seen the Chuck Taylor and can identify these unique traits.
