This week was an above-average one for patent filings in both the Patent Trial and Appeal Board (PTAB) and in district courts. The PTAB had two new post grant review (PGR) petitions and 39 new inter partes review (IPR) petitions, for a total of 41 new filings. And the district court also had heightened activity with 75 new filings.

It was an average week all around with 31 new patent filings at the Patent Trial and Appeal Board (PTAB) – all inter partes reviews (IPRs) – and 67 new filings in district court. The bulk of this week’s new PTAB filings (a total of 19) were petitions challenging patents owned and asserted by Entropic Communications LLC [associated with SoftBank Group Corp.] (discussed further below). Other notable filings include petitions challenging patents held by Softex [associated with SoftBank Group Corp.], Dental Imaging Technologies [associated with Envista Holdings Corporation], Resonant Systems [d/b/a RevelHMI], Immersion Corp, and Dsm IP Assets BV [associated with DSM-Firmenich AG].

It was an average week for patent filings at the Patent Trial and Appeal Board (PTAB) and an above-average week in district courts, with 72 district court complaints filed and 18 new PTAB petitions—one petition for Post Grant Review (PGR), and 17 for Inter Partes Review (IPR). At the PTAB, a number of challenges were filed, including two IPRs by Tesla challenging patents owned by Iqar Inc, four IPRs by Dish challenging patents owned by Entropic Communications LLC (associated with Fortress), two IPRs by Microsoft challenging patents owned by Interdigital Patent Holdings Inc (associated with InterDigital Inc.), and two IPRs by Juniper Networks challenging patents owned by Monarch Networking Solutions LLC (associated with Acacia Research Corporation).

It was a busy week at the Patent Trial and Appeal Board (PTAB) with 40 new filings—all inter partes review (IPR)—and an average week in the district courts with 51 new filings. The bulk of new PTAB filings can be attributed to a few petitioners challenging multiple patents held by one patent owner (and all asserted in parallel district court litigations). For example, Apple continued its filings against Carbyne Biometrics LLC [associated with Bjorn Markus Jakobsson] patents, adding another five petitions against four patents to the two filed earlier this month

It was an average week for patent filings at the Patent Trial and Appeal Board (PTAB) and a slightly above-average week in district courts, with 62 district court complaints filed and 21 new PTAB petitions—one petition for Post Grant Review (PGR), and 20 for Inter Partes Review (IPR). The PTAB instituted 13 cases; iInstitution was denied in 12 cases and 15 cases settled. In district courts, 62 new cases were filed and 12 cases were terminated.

Filings began picking up again this week after a slow start in the new year in both the Patent Trial and Appeal Board (PTAB) and district courts. The PTAB had a busy week with 31 new filings—one Post Grant Review (PGR) and the rest Inter Partes Reviews (IPRs). Nearly half of all new PTAB filings came from just two entities: Apple and Neurent Medical…. The PTAB was also busy issuing 27 institution decisions (21 instituted and 6 not instituted).

The first week of 2024 was a light one for patent filings. The Patent Trial and Appeal Board (PTAB) had a slightly below average 21 new petitions—all petitions for inter partes review (IPR), while there were only 34 new filings in district court. The PTAB saw new IPRs filed against Advanced Coding (filed by Samsung), XR Communications (filed by Ericsson) and Semiconductor Design (filed by Cadence Design Systems). Four new IPRs challenging three Senko Advanced Components Inc. [associated with Senko Group Holdings Co, Ltd.] patents were filed by US Conec Ltd. After low activity throughout 2023, Askeladden has filed three new IPRs challenging three Calabrese Stemer LLC patents and four new IPRs challenging three Intercurrency Software LLC patents.

It was an overall below-average week for patent filings at both the Patent Trial and Appeal Board (PTAB) and district courts. The PTAB had only 15 new PTAB petitions—all inter partes reviews (IPRs), while the district court had only 24 new complaints filed. There were two more Fintiv discretionary denials this week, with the Board denying institution of two IPRs filed by IBM against inventor-controlled DigitalDoor Inc. [funding unknown] patents broadly related to various aspects of data security technologies.

At the PTAB, Hyundai filed two new IPRs against Mel Navip LLC [associated with Ni, Wang & Massand, PLLC] patents; Fortinet Inc. filed two IPRs against one Lionra Technologies [associated with Magnetar Capital] patent; and Apple filed two IPRs against DoDots Licensing Solutions [Strategic Intellectual Solutions] patents.

It was a typical week for patent filings at both the Patent Trial and Appeal Board (PTAB) and in district courts, with 25 new PTAB petitions (five post grant review and 20 inter partes review) and 53 new district court complaints filed. At the PTAB, there were three procedural denials under Section 325(d) (and denying patent owner’s request to deny under Fintiv) in IPRs filed by Nokia Corp. against optical networking patents owned by Alexander Soto and Walter Soto and asserted by inventor owned-NextGen Innovations, LLC.

It was another slow week for patent filings at the Patent Trial and Appeal Board (PTAB) and a typical week in district courts, with 52 district court complaints filed and 22 new PTAB petitions. There was a new discretionary denial, a bunch of litigation-provoked high-profile PTAB challenges, and some notable new litigations. There was another Fintiv discretionary denial this week: here, a Chinese patent owner, Ningde Amperex Technology Ltd., benefited from the Board’s discretionary denial rules in a petition brought by another Chinese battery company. The case, IPR2023-00585, leaves unaddressed the questions raised about the validity of U.S. Patent 11329352.

It was a slow week at the Patent Trial and Appeal Board (PTAB) with just 18 new petitions—all inter partes reviews (IPRs); in district court, a slightly below average 54 new patent filings and 48 terminations rounded out the count. District courts saw continued filings in several large campaigns. Unwired Global Systems LLC (associated with high volume plaintiff, Jeffrey Gross) adds another seven defendants to its campaign, asserting a single patent related to home area network middleware interfaces and inventor-controlled Optimum Imaging Technologies LLC filed suit against six defendants asserting patents related to, not surprisingly, digital imaging, bringing the total number of defendants to seven.

It was a relatively average week for patent filings in the district court with 59 new complaints. New filings included multiple filings associated with high-volume plaintiffs such as Jeffrey Gross, Leigh Rothschild, as well as a slew of filings from Pueblo Nuevo in a banking campaign. Meanwhile, XR Communications settled three inter partes reviews (IPRs) and filed two new cases against wireless carriers.

It was another low patent-filing week at the Patent Trial and Appeal Board (PTAB), with just 12 new petitions (about half of last year’s average); district court filings were average with 47 new filings. Acacia subsidiary Atlas Global received more petitions on patents that are part of its broad assertion campaign; some Centripetal patents were instituted by a defendant in that going campaign; Intellectual Ventures appears to have settled the latest round of automotive litigation before Judge Albright, ending that case; and IP Edge continues to not file new cases and settle old ones, in the wake of the end of the year discovery battles. Zillow was instituted on patents IBM had asserted or threatened; and the Vidal administration is the latest recipient of yet another Gil Hyatt suit.
