The PTAB Promotes Petitioner Promiscuity

Why in the world would the federal government want to be an active participant in invalidating patents that the USPTO grants? Does the federal government believe that an insufficient number of patents are challenged through inter partes reviews, that there is insufficient gang tackling (which occurs when another petitioner requests joinder using a near-photocopy of the original petition), or that there are insufficient serial attacks on the same patents? To put the last issue in other words, does the federal government really believe that nine attacks against some patents are needed?

The High Tech Inventors Alliance: The newest institution of the efficient infringer lobby in D.C.

Eight tech companies owning a collective 115,000 patents announced the establishment of the High Tech Inventors Alliance (HTIA), an organization they claim is “dedicated to supporting balanced patent policy.” According to coverage by Congressional blog TheHill, the formation of the HTIA is intended to further debate on Capitol Hill over patent reform… The members of the alliance are your typical “Who’s Who” of the efficient infringer lobby… Every member of the HTIA, including Adobe, Cisco, Oracle and Salesforce.com all lobbied on issues related to the Innovation Act.

Innography report pegs Salesforce.com, Tesla as top innovative firms

This list of top innovators put together by Forbes has been further refined by intellectual property analytics firm Innography to take a more objective, data-based approach in determining the world’s most innovative firms. In a report titled How Innovative Are They?, Innography takes the top five companies on Forbes’ list (Tesla, Salesforce.com, Regeneron, Incyte and Alexion, respectively) and measured them against six metrics: number of inventions; number of inventors; inventor locations; patents per inventor; and a metric Innography refers to as PatentStrength, a measure of both patent quality and filing activity.

Salesforce.com Sued for Patent Infringement

Lexington Technology Group (LTG), an intellectual property management firm, announced on Monday that its wholly owned subsidiary, Bascom Research, filed a patent infringement lawsuit against Salesforce.com in the Northern District of California. Bascom Research is a software development company focused on building solutions for the management of complex and distributed data in healthcare and other fields. The company owns patents that relate to social networking and aspects of enterprise networking. In 2012, Bascom Research brought claims for patent infringement against five defendants, including Facebook, LinkeIn and Novell.
