On March 28, the U.S. Commerce Department issued a strategic plan for fiscal years 2022 through 2026 designed to enhance American competitiveness through the 21st century in several critical areas of the economy, including broadband Internet and supply chain resilience. At several points throughout the Commerce Department’s strategic plan, the importance of intellectual property and the stability provided by certainty in patent rights are acknowledged as key contributors to spurring innovations that benefit American competitiveness against foreign rivals.

USPTO Releases 2018-2022 Strategic Plan to Optimize Timeliness and Quality

The U.S. Patent and Trademark Office recently released its 2018-2022 Strategic Plan, setting various goals to ensure high quality services for the agency’s customers and stakeholders aligned with the Department of Commerce’s strategic objective to strengthen intellectual property protection… “We are confident in attaining the goals set out in this plan and look forward to the continued engagement and feedback from our stakeholders and employees,” Director Andrei Iancu is quoted as saying in a press release issued by the USPTO upon the release of the new strategic plan. “Together we celebrate innovation and entrepreneurship—we are very proud of the men and women who stand behind a well-balanced American intellectual property system.”

Creating a winning patent strategy from the ground up

The very nature of preparing a patent strategy is something that requires both understanding of the patent laws and a healthy understanding of the business realities of evolving technologies. In order to plot a course calculated to succeed company leaders need to be cognizant of the actual business realities facing the company, not the talking points of lobbyists or those who write SEC filings or those who get paid to write press releases. Indeed, a comprehensive understanding of your own research and development, as well as where the industry is heading, is crucial when attempting to create the patent strategy that has any chance of succeeding.

Deliberate Success: Developing a Winning Patent Prosecution Strategy

The availability of information to gain insights based on what is happening to others who are similarly situated means decision makers can leverage the experiences of many when determining how best to proceed. For example, in the patent world if you file an application that gets classified in Class 705 that means you have little or no meaningful chance to obtain a commercially relevant patent. Truthfully, you have little or no chance to obtain any patent really. So what decision do you make moving forward? Are you going to continue to throw good money after bad money to wage a fight that you realistically have virtually no statistical chance to win?

USPTO 2014-2018 Strategic Plan Available for Public Comment

The U.S. Department of Commerce’s United States Patent and Trademark Office (USPTO) today announced that the USPTO’s draft Strategic Plan for fiscal years (FY) 2014-2018 is posted for public review and comment on the USPTO website. The draft plan sets out the USPTO’s mission-focused strategic goals: to optimize patent quality and timeliness; to optimize trademark quality and timeliness; and to provide global and domestic leadership to improve intellectual property (IP) policy, protection, and enforcement worldwide.

Kappos Reorganizes Operational Structure at Patent Office

The first “new” Office within the USPTO is the Office of the Chief Communications Officer, which is formerly the Office of Public Affairs within the Under Secretary’s Office. The second “new” Office is the Office of Equal Employment Opportunity and Diversity, which was formerly the Office of Civil Rights within the Office of the Chief Administrative Offices. These two “new” Offices now report directly to the Under Secretary and Director and are represented on the Agency’s Executive Committee.

USPTO Extends Comment Period for Draft Strategic Plan

The United States Patent and Trademark Office (USPTO) announced that the period for receiving public comments regarding the agency’s 2010-2015 draft Strategic Plan has been extended until August 2, 2010. The extension has been made to allow more time for the public to provide feedback to the agency about the plan.

Renewed Congressional Interest for Funding the Patent Office

Truth be told, it would be enough for Congress to just (1) stop siphoning off money from the USPTO through fee diversion; (2) grant the USPTO fee setting authority; and (3) stand out of the way. So my message to Congress would be this: put the pocketbook down, slowly step back and raise your hands over your head so we can see them!
