The World Intellectual Property Organization (WIPO) has published its annual World Intellectual Property Indicators. For the second consecutive year, the number of design applications filed worldwide continued to grow, with an estimated 963,100 applications filed in total globally. The 2016 growth rate was 10.4%, following 2015’s more modest growth rate of 2.3% and 2014’s 10.2% drop in applications. 90% of the growth in 2016 can be attributed to increased filings in China.

This year on Thanksgiving I find myself recovering from back surgery, so in addition to my annual thank you message to readers — your reading makes this all possible and worthwhile — I have a few other “thank you” messages to share… This patent covers a method for de-boning a turkey prior to cooking such that it can be cooked more rapidly and with less oven space.

A major legal battle over patented technologies in the mobile device communication sector between San Diego, CA-based semiconductor developer Qualcomm Inc. and Cupertino, CA-based consumer tech giant Apple Inc. took a new turn as multiple news reports indicated that Qualcomm had filed suit in China seeking a ban on the sale and manufacture of iPhones. Qualcomm’s court filing in China is the latest salvo in a barrage of legal challenges between both company’s over licensing activities between Qualcomm, Apple and the many Asian contract manufacturers who fabricate smartphones for Apple which incorporate technologies allegedly covered by Qualcomm’s patents.

On Monday, October 9th, San Diego, CA-based fabless semiconductor developer Qualcomm Inc. (NASDAQ:QCOM) announced that it had entered into a licensing agreement with Istanbul, Turkey-based General Mobile, a regional smartphone brand and a partner of the Android One smartphone project developed by Google. The royalty-bearing patent license grants General Mobile the right to develop, manufacture and sell 3G and 4G complete devices which incorporate technologies that are covered by patents in Qualcomm’s portfolio.

Since our last turkey patent report over Thanksgiving 2015 there have only been 5 U.S. patents issued with the word “turkey” in the title, which suggests a steep and rather unexpected decline in the number of turkey related innovations year over year… But the point of this article isn’t just to remind you to let Archimedes by your guide, or to identify a handful of recent patents that deal with turkeys, make a gratuitous mention of football (go Cowboys!), weave in mention of Presidential turkey pardons, or even to take a cheap shot at the PTAB (although I couldn’t resist). Protection of the official names of States and prevention of their registration and use as trademarks have been the focus of attention of the Standing Committee on the Law of Trademarks, Industrial Designs and Geographical Indications at the World Intellectual Property Organization (the “SCT”) for over six years (since June 2009). Each of the WIPO Member States has both its own national procedures with their peculiarities and some coinciding positions on the subject. Generally speaking, when performing the examination, the competent national authority examines the sign applied for registration as a trademark and consisting of or containing the name of a State in light of formal and substantive legal requirements, like any other sign.

The 2015 report dissects the macro trends associated with filing activity and registrations for 2014 in the following intellectual property areas: patents, trademarks, industrial designs, and plant varieties… The twenty-year era of growth in industrial design patent applications came to an abrupt end in 2014… The decline in global applications stems primarily from the pronounced decrease in resident filings at the State Intellectual Property Office of the People’s Republic of China (SIPO), which fell 14.9% over the past year.

Since last Thanksgiving there have been 11 U.S. patents issued with the word “turkey” in the title. What does this tell us, that there isn’t a lot of patented innovation in any given year dealing with turkeys. Of course, that really isn’t the point of this article. In 2013, 647,300 industrial design registrations were filed – a 6.4% drop from 2012. The decline in global registrations stems primarily from the slow-down of Chinese manufacturing, which produced 12% fewer registrations than the previous year. After seven years of consecutive growth, 2013’s global registrations of 919,100 designs represents a 3.3% decrease from 2012. In 2013, upwards of three million industrial design registrations were in force.

On this most festive of American holidays I once again am inspired to share some thematically appropriate patents. After all, what better way to celebrate a holiday than reading patents appropriate for the festivities? With that in mind, I celebrate the turkeys that won’t get away. You know, the ones who are not lucky enough to receive a Presidential Pardon — the ones you and I will be enjoying with family and friends! So with that in mind I have turkey frying on the mind.
