Software Patent Eligibility: How to Articulate a Patent Eligibility Invention

In the United States software is patentable. While it is often said that over the last several years it has become increasingly difficult to obtain software patents in the U.S., it is probably more accurate to say that while it has become increasingly difficult to obtain these patents it has become even harder to keep these patents once they are issued. As a result of the Supreme Court’s decision in Alice v. CLS Bank it seems that federal district courts, the Federal Circuit and the Patent Trial and Appeal Board find computer implemented innovations to be patent ineligible abstract ideas with astonishing frequency. This webinar will review the most recent decisions of note relating to patent eligibility of computer implemented inventions, and offer strategies for describing these inventions so they can both pass muster at the Patent Office and stand the test of time in the courts and at the PTAB.

Unlocking the Value in Software Patents – A Technical Perspective

Alice has had an impact on software patents, but they still hold significant value.
